Burglary suspect killed while breaking into home, Cumberland County deputies say

Breaking into an occupied dwelling and shooting the occupant? That's not burglary.

Criminal trespass, breaking and entering, attempted murder, possession of a firearm during the commission of a felony? Sure. Burglary? Nope.

Good riddance.

This comes after a nearly similar incident Wednesday at 507 Snow Hill Road in Fayetteville.

Imagine the tragedy if these two incidents had actually been similar?!

In any case, we need more of this type of first responder home defense.
 
Yep, keep turning these low lives into fertilizer and their buddies will start thinking twice about entering another mans home uninvited.

Glad to see this being handled out of court. Hope the homeowner that was injured recovers with no issues.


Unlikely. Hard to get shot and not have issues. But maybe nothing physical.

Burglary is the act of entering a building without permission with the intent of committing a crime inside.

So, yeah it was burglary as well as all the other things.

Huh. I thought "burglary" was specific to theft and non-occupied bldgs. Occupied (again, acc'ding to the Notions of Windini) upped the ante, and "crime" being too general (and potentially far more violent) for a burglary charge.

It varies by state but in NC occupied or not is the difference between 1st and 2nd degree if memory serves. Been awhile since my last criminal law class.....
 
For a town with such a high percentage of shit kickin' paratroopers, snake eaters & even scarier dudes 'n all kindsa vets livin' there with that type of background, you'd think criminals would reconsider the wisdom of kickin' in folks' doors.

This^^^^^^ in S.C. I think there are 3 degrees. The right one will get you LIFE. If I remember correctly that one requires entry to an occupied dwelling while being armed.
