yeah, those cops either had no friggin clue what they were doing, or just wanted their authoritah respected moar and figured they could arrest him for whatever and let somebody else sort it out later. they have qualified immunity if they claim they didn't know...
 
If use peons are suppose know the law and not knowing is not a excuse then these cops need to be fired along with the DA.

How often have we heard, "Let the courts figure it out" or something similar. The only thing is that going to court is NOT cheap, and that is at the root of the so called two tiered "justice" system.


I have an idea that should help in a number of ways. Let's do let the courts figure it out. Take this case as an example. He goes to court and is found guilty. Sentenced and done. But it he is found not guilty he has to be put back to where he was before the arrest. No record. Compensated for lost wages and new job if old one is not available. All at the expense of the arresting department. First benefit of that is the arresting department is gonna make sure of what they are arresting for so no more BS arrests and "let the court figure it out. Second benefit is the courts won't be flooded with "figuring it out" so DA's can actually do their jobs and stop plea bargaining cases they don't think they can win. The best benefit is people who did nothing won't have their lives destroyed.

Ok so I am no J. K. Rowling but it was a nice thought while it lasted. :(

But liberal judges in NJ are just as corrupt as the LEO who stopped the guy not to mention the total ignorance of any
jury members who might decide the fate of this poor guy. Definitely a catch 22.

What you described is called accountability and consequences for breaking the law. Sad to say but it ain't ever gonna happen.

When I saw that I first thought it was a The Strip from Fallout New Vegas. Definitely need some good ammo.
 
What do we expect from NJ, the state is run so far left it is almost criminal. DA drops charges because any judge would slam the JV ADA who would have been assigned to prosecute this weak case in the first place. They tied up at least two or three officers that could have been on the street on patrol. We have seen LEO like this on Audit the Audit, they have a stick up their rear ends and will do anything to get a citizen to admit to crime(s) and or get upset and cause more charges to be made for a simple traffic stop. I don't expect all LEO to know 100% of all the laws, that is what the book is for but they know full well that the ammo this man had is not what they have loaded in their three to five magazines on their duty belt.

this is so damn true. I donā€™t really understand what ā€œinnocent until proven guiltyā€ means I guess, because it seems the burden of proof is in the individual, esp financially . Police need to have much more accountability to prevent them from arresting as default response to ignorance.

I could get arrested tomorrow for eating French fries. Itā€™s me who has to then pay a lawyer to go through the code and demonstrate that eating French fries is not illegal. The example is silly, yes, but it illustrates how crazy the system is. My life would be ruined because someone didnā€™t know the law. A good example beyond this one was the video camera guy, who just happened to be a lawyer. Fortunately that officer was made an example of. We all deal with shit that makes our jobs more difficult, thatā€™s the world. The difference between my line of work and theirs is they can financially and professionally ruin peopleā€™s lives. I would just get told by HR I canā€™t do X or Y.

of course. Itā€™s ludicrous to expect them to know 100% of law. Lawyers donā€™t even know that. Thatā€™s why they specialize. The hiring standards and training for LE are substantially lower than for a lawyer, so itā€™s even more so the reality.

the issue here was these officers werenā€™t doing anything useful. Letā€™s say they WERE hollow point ammo. This is just some professional guy with a job related gun. NJ has plenty of real crime to worry about rather than spending time jamming up some working stiff over bunch of bull shit.

For about the first one hundred fifty years, criminal justice was privatized, not govt. in this nation. There were no govt. police. This is just another example of where govt. justice is a misnomer. The govt. has nearly infinite resources to bring to bear against an individual and their first moves likely cripple the individual financially.

If it actually cost to attempt to prosecute someone, especially for a victimless ā€œcrimeā€, I can guarantee you those paying to prosecute wouldnā€™t be bothering so much with stuff like this.

The entire system needs reform, from the ground up.
