A win in California

Where was this court in 1992?

Now let’s see if this affects New York State.

It’ll get appealed to a really anti 2a court next, but it feels like this judge wrote his ruling with an eye towards this being a case that ends up at the Supreme Court.

There is a decent chance this wont happen to prevent it from going all the way to SCOTUS.

Yeah, my buddy’s back behind enemy lines are ready to melt their credit cards.

Not sure what to make of this...PSA posting one thing and now Buds Gun Shop just posted this on their website:

Unfortunately, we are still unable to sell high capacity magazines to our CA customers. The recent court ruling only blocked a 2016 law that would have made high capacity magazines already owned by CA residents illegal to possess or sell.

An example of folks interpreting the ruling/law as they see it in an attempt to "cover their ass" (for some reason or another)....really no different than folks selling a long gun in BST and requiring a BOS, CCP/HPP, transfer via FFL holder, photo of DL, blood/urine sample and the list goes on and on.

It's not that BGS is "unable" to sell STANDARD capacity magazines to folks in CA...it's that they "won't" sell them.

Oh well....their business, their rules, but PSA and other vendors willing to sell/ship tools of liberty to the good folks in CA are gonna make a killing.

Think I'll jump over to CTDs website to see if they've started gouging in anticipation of the increase in magazine orders.

No doubt the State of CA will pull some appeal on this.

NRA also worked with local grass roots groups to get our concealed carry where it is today and reciprocity.
Just as our rights are chipped away a little at a time, our gains are made one case at a time.

NRA may not be perfect, but what group is, NFL, NBA, NSSF, ARRL, etc etc etc.
I'm a NRA Lfe Member for the record.

Courts open there in 3 hours, I suspect a stay of execution will be the first thing that gets processed.

Predictably, no one is running mag deals right now as they cater to the CA market for however long that lasts. Before the ruling, it was easy to find PMags for $8 shipped. Now, they are back to "regular" price of $12ish and up.

There have been some cases in the past where the gun grabbers lost at the Circuit Court level, and decided to let it stand. If they go for broke and lose at the Supreme Court, the ruling applies to the whole country. They will count their votes and if it doesn't look good, they will stop there. Until they have the votes, we know they are like the Terminator and will never stop until they have everything they want, which is everything.

Buying frenzy in CA! I have some co-workers burning up their credit cards...

I noticed some sites were showing "out of stock" Sunday and now magically, pmags are in stock. I ordered 10 a few weeks ago from PSA for a total of $85.70.

I saw one site saying due to overwhelming demand in CA, they are temporarily not shipping to CA at the moment.

Interesting that many cases are brought in the 9th and have impact on the rest of the country.
Perhaps I should start this as a new thread...

Trump reshapes long-liberal 9th Circuit, as Republican-appointed judges gain seats on court
For the first time in more than three decades, Republican-appointed judges will soon occupy nearly half the seats on the left-leaning 9th Circuit Court of Appeals -- dealing a setback to progressive legal advocates who have long seen the court as a safe bet for favorable rulings.

But doesn't CA have a detachable magazine ban in effect? I know they purchase normal magazines now, but I don't think they can legally use them in AR's

The AR Maglock keeps you legal.

Not necessarily. We can have a featureless rifle and still have a detachable magazine. Only when we have features of what California has defined as an assault weapon (pistol grip, flash hider, fore grip, etc) does that kick in the requirement to have a fixed magazine that can only accept up to 10 rounds.

For California even with this devise we can’t install a fixed magazine that accepts more than 10 rounds. There will probably be some Californians who get into legal trouble trying to install a 30rounder into their AR 15 equipped with multiple features of an assault weapon. Featureless rifle with more than 10 rounds ok but not on a standard AR with a fixed mag.

I haven’t been keeping up. Is the ban-lift in trouble? Wasn’t sure if this email was because something was being changed again or not:

Nice while it lasted. You kids get ready to give all those huge evil pmags back to the crown after the next batch of old farts in robes tells you it's not OK because of reasons.

Interesting, 1000 and 1000 of standard capacity magazines were ordered in one week. The 9th circus court will be in a bind by disregarding the “in common use”SC opinion but we know that the clowns sitting on that court are very good at mental gymnastics.

The 9th has a mind of their own. They don’t seem to follow the constitution. The only good thing going for it is that Trump has appointed a number of more conservative judges to it. Our only hope is that that makes a difference when the appeal is herd and final judgement made. It’s likely this case could go to the SC.

Give trump another term with a republican senate and he will fix that "For the first time in more than three decades, Republican-appointed judges will soon occupy nearly half the seats on the left-leaning 9th Circuit Court of Appeals -- dealing a setback to progressive legal advocates who have long seen the court as a safe bet for favorable rulings."

Evidently PSA isn’t going to honor DST and squeeze another hour out of it. :D

(Or maybe they’re still stopping 2 hours early? Not sure if the deadline is always ETZ?)

"All the people who bought the magazines in the last week are protected from prosecution, but any further purchase of these magazines is illegal for the moment," Michel said. "There was 20 years of pent up demand for these self-defense tools, and several hundred thousand people bought them in the last week, maybe more than several hundred thousand."

Attorney General Xavier Becerra, who sought the stay, warned in a court filing that it would be difficult for the state to remove the newly purchased magazines, even if the ban is reinstated.
