South Carolina AG Warns Mayor Over Local Gun Control Laws

While there’s been a lot of handwringing by anti-gun activists over the Second Amendment Sanctuary movement, which they claim undermines the rule of law, I haven’t noticed any of them complain when anti-gun politicians pass local gun control ordinances in violation of state firearms preemption laws. The latest example of the hypocrisy of the gun control movement comes from Columbia, South Carolina, where Mayor Steve Benjamin signed two local gun ordinances into law in September, despite South Carolina’s firearm preemption law.

The first ordinance bans possession of a firearm within 1,000 feet of a school, and another establishing a local “red flag” law. South Carolina Attorney General Alan Wilson has now fired off a letter to the mayor warning him about the violations of state law.

“In an effort to uphold the rule of law and to ensure the protection of taxpayers, this office strongly urges that these ordinances be repealed,” Wilson wrote Tuesday. “The ordinances not only undermine state law, but undercut the Second Amendment. They are an open invitation to costly litigation for which the municipal taxpayers must pay.”

Wilson bolstered his letter to the mayor with a pair of opinions from his office. State Rep. Jonathon Hill, a Republican from Townville, requested an attorney general’s opinion on Columbia’s extreme risk protection order law, while State Sen. Ronnie Cromer, a Republican from Prosperity, and state Rep. Bill Hixon, a Republican from North Augusta, asked for an opinion on the school zone ordinance.

In both opinions, among other findings, the attorney general’s office says that state law takes precedent in terms of firearm regulation.

“With but a few exceptions, a city or county cannot interject itself into the regulation of firearms,” Wilson writes. “Yet, the City of Columbia has done so repeatedly.”

that's already a federal law circa 1990 IIRC. Not sure if there's an exception for driving but there's a 1000ft gun zone around a school. Well unless I'm there :D

FWIW NC CHP excludes you from this in state law, and there's the 'framework' for affirmative self defense on school grounds.........but I wouldn't want to be the test case nowadays.
 
Y'all in SC are lucky to have such an Attorney General. Ours is a left wing gun hater with big ambitions for higher office. News and Observer coverage of him is so rosy, they have all but photoshopped halos over his head.

The first thing I thought of when I read this is that our Governor wants to repeal state firearms preemption laws so localities can do this exact type of patchwork of laws, making everyone into criminals. It's meant to terrorize the populace into never carrying firearms again because it would be impossible for everyone to be aware of the endless locality laws as they drive around.

Mr. Cooper is a Democrat, so you know he's anti-gun, but he tries to portray the "good ole Southern boy" shtick, at least when he's outside of Raleigh. I haven't seen him come out and say anything other than the standard "common sense" stuff. Where did you hear this specific thing? It needs to be talked about more.

Our AG is the son of Joe Wilson. The Congressman who yelled "You Lie" at O'bammy at State of the Union address.

A very old friend of the family is the patriarch of a Blue Dog democrat family. He is liberal on some things, but guns? He said, about Cooper, "you just can't be Southern and a gun-grabber. That's like a New Yorker who hates bagels."
 
As an aside. A few years ago Murder Beach "passed" a city wide helmet law. They stopped Many folks, wrote Many tickets, collected Much money. All the while Knowing what they were doing was illegal. The new Mayor at that time ran on a singular platform...I will run these motorcycles out of MBSC...He was elected and he performed exactly as he promised...welllll kinda. His new law went into effect before Harley Dealer Rally and he ran the rally outta MBSC. They have never come back. The local college business program said it cost the city $300 Million dollars. At an average attendance of 300 Thousand and an average expenditure of $1,000 per person for 7 days, it was costly. Never the less, they got what they wanted.
As to their Helmet Law, that they Knew was illegal, it was struck down by the S.C. Courts. Never mind all the tickets and arrests they issued.
Same "should" be with this BS gun law for Columbia. This is why I say, when talking about local Poleeeece...if they want your as.s..they'll have your ass. The law be damned!

Oh and If the rumor mill is to be believed....he is a major Player in Palmetto State Armory.
PSA must absolutely enrage the Columbia liberals (being mostly local there), especially when they hear whatever enormous number of cheap ARs they shipped last week :)
