If the serial number was removed that gun is illegal to possess by anyone. As far as the seizure of personal property, it sucks but that gun is evidence in a criminal matter. The Government isn't the one who did that to you though, the criminal did.It's questionable I will get my wife's firearm back due to the one of the S/N being ground off. I'm hounding the defective and arresting officer regarding this. The "we got a buy guy off the street" is true and I'm thankful but the gov't seizing our personal property without cause and without payment for the firearm is unjust. I was told I could drop the charges and get my firearm back DA is really after this guy. (It may go federal.) However, it was a small price to pay to have someone like that behind bars. I mention, well it's two options we currently have. I'll drop the charges and get my firearm back or gov't can pay me or (what I want) is the firearm back and the guy put away for a long time..

Send his ass to the federal pen and then file civil suite for cost of the gun. Maybe they take his canteen money for a couple of years to pay you back. I think you're "funny" I'm going directly by what the detective told me, don't shoot the messenger. In federal court they could pin that he stole the firearm out of our car(s), I'm certain this is the charge he was referring to. However talking with arresting officer the day after my daughter was born, he does not remember the S/N being ground off and he has one. The ATF local to the area I've been trying to get his contact info to get to the bottom of this.I think it's funny you think "you" can drop the charges. They are not your charges they are the States charges you were just the victim. The victim has no say in the charges and considering the amount of time it's been they probably did not charge the person with the B&E of an automobile but just the possession of stolen firearms and possibly possession of firearms by a felon so you actually are not even the victim in these crimes.

Yea, I'll never get anything out of this crook off the streets for a while. If it goes to court, and win..doesn't mean I'll get anything in this lifetime. Would end up back in court for non payment/etc. at that point my time alone would of cost that much. All around just sucks.
Talked with the ADA, he assured me he is gone for a long long time. In 10 years he may have been out for total of 14 months. But saying something and doing something are two completely things.

I didn't mean to come over so harsh and I apologize for that tone. But the officer failed in giving you the proper information.
