Hey guys, I did a little googling but couldn’t really find a direct answer, so please don’t bite my head off. Trying to do this properly and legally.

I recently purchased a used AR pistol with a shockwave brace from a dealer, according to the most recent ATF wording I have seen, it’s legal to shoulder a brace as long as you don’t make a habit of it. Final ruling on my end is the shockwave is painful to shoot and most braces are close enough to tax stamp price that I’d rather just do it “right”.

So, my question is, can I take my existing pistol and turn it into a SBR by following form 1 guidelines, or do I need to start with a brand new lower and classify it as an “other” before starting the paperwork? And lastly, can it be a pistol and be used as a pistol until the tax stamp comes back? Or does it need to be disassembled and stored until I’m given the go-ahead?

I appreciate any and all advise.
 
If you choose to go the SBR route mine came back in, I think, 10 days. It was nuts how quick it was.

The recent rulings on "pistols" and shouldering them pretty much come down to they just don't care any more. Do whatever. I own 5 SBR's that i built before the shouldering rulings and to be honest I won't build another. No point in them.
 
I’d recommend buying an SBA3 first before you decide. You might decide that’s way more comfy, and you don’t have to file the Form 1 or worry about crossing state lines...plus it’s then covered under a NC concealed handgun permit. ;)

The good news is since it started as a pistol, you can make it a rifle and still go back to a pistol.

Meh, going against the grain here. I only have a pistol lower for backup/ccw.

I much much prefer having an SBR lower that I can shoot with any upper in matches and competition. A pistol AR is next to useless to me. I don't carry a rifle around unless I am going to go shoot it.

I'd happily pay 200$ just to have a 14.5 over a 16, because 14.5 middy is about perfect, but I can also throw my 12.5" or other uppers on it (even .22LR). Just my opinion.

You can put a pistol upper on a pistol lower and you can put a 16" plus rifle upper on a pistol lower. Only difference between a rifle and a pistol any more is the thing you put against your shoulder.

Thank you. I am quite aware of that. I have both.

You cannot shoot a pistol in a rifle match. Or a 2 gun match. Or a 3 gun match. And, you cannot shoot a 5.56 pistol in a pistol match.
