I agree with you. The only reason I returned my EXPS2-0 is so I can get the two-dot EXPS2-2 with my refund. I'm debating whether to go ahead and purchase the EXPS2-2 and use the settlement check to reimburse the old "gun fund" in a month or two when the check arrives.

The only reason I participated in the lawsuit is because my eotech was so dim on the highest setting that it could not be seen in daylight. I contacted eotech about it and they told me the warranty had expired and they would not repair it even at me expense or offer me a new one at a discounted price. With customer service like that I'm going to use the settlement check to buy 3 Vortexes.
