I read this article in the News & Observer (It was in Charlotte's paper as well) and was aghast at how Emperor Cooperus Augustus can just issue a decree that rewrites eviction law in NC and expect everyone to go along with it!

"Cooper’s new order now also prohibits new filings or other eviction proceedings against a tenant for nonpayment or late payment of rent, and offers more sweeping tenant protections, including:
  • Prevents landlords from assessing late fees or other penalties for late or nonpayment.
  • Prevents the accumulation of additional interest, fees or other penalties for existing late fees while the order is in effect.
  • Requires landlords to give tenants at least six months after the order ends to pay outstanding rent.
  • Requires leases to be modified to disallow evicting tenants for reason of late or nonpayments."
The immediate effect is that a lot of tenants are going to get free rent as long as it goes on, then they will move out. I used to rent out a townhome in Raleigh, and if my tenants didn't pay, and I couldn't replace them with someone who did, things would be getting pretty tight around my house as well. (But don't worry, I'm sure .gov has a program for that and will gladly welcome me onto Uncle Sam's plantation).

But my biggest concern is that nobody is asking WHERE DOES THE GOVERNOR GET THE AUTHORITY TO DO THIS? We have eviction laws in this state. How does he get to unilaterally rewrite them and just hand them down like King George? WHY IS NOBODY UPSET ABOUT THIS OBVIOUS POWER GRAB?

These mandates pretty well mirror California law. It has been in place for about 18 months now. It has nothing to do with The Carnival Virus. Can you Imagine having rental property under these restrictions??? King Fish Huey Long wasn't this crazy.
 
Well, I wonder how long the tenets will stay there after the bank has foreclosed from the owners and then force the bums out!? This is a power play writ large! So just WHO will end up with all of this property once it has been foreclosed on?

Unfortunately there are “tenants rights” groups that just salivate over the chance to litigate when a landlord makes the right economic decision for his business. Honestly, requiring landlords to accept additional risk from delayed rent payment and slowing eviction sure seems like government property seizure to me.

Yup, the executive branch will always overreach. Sadly the judicial branch has not been a very effective control on this.
