Help Needed!! BIL Just Got Arrested Carrying in NJ

I agree, @B00ger got me to thinking about this differently. We had a post on here a while back where an officer in DC (maybe like the parking garage at the Smithsonian?) saw/found/discovered a weapon and let the citizen leave town quietly. He didn't get a felony charge for something that wasn't even illegal ten miles south of there. Maybe in this NJ situation, the officer wasn't able to do that because other officers were present and overheard, or it was somehow recorded. I expect that management wouldn't look kindly on an officer looking the other way from an obvious felony charge.

The whole idea of getting busted for something you own, vs. something you do, is just stupid anyway. Just having it shouldn't be a crime; doing something bad with it should be.

I wonder if the officer was wearing a Body Cam with sound and if they review the recordings. it would make it hard for the officer to use discretion if there is a recording of him telling about a Illegal gun
 
i lived in Mass for a long time had a carry permit. If your stopped they already know you owm guns,

they don't know if you carrying, Golden Rule "don't tell them" and move on.

Evan Nappen is an attorney that focuses on firearms law. He splits his time between NH and NJ and is very active in gun rights. He needs an attorney in NJ.

I had an issue in NH where the Chief exceeded the statutory limit and put an unlawful expiration date on my wife's license. He quoted me a very reasonable fee, but NH law stipulates that the violator pays attorney fees & costs. Personally. I think he just wanted the opportunity to stick it to one more crooked cop.

Read the last six pages. It's good he got Nappen - it's his best hope. Unfortunately, NJ has a new asshat leftist governor, a state Attorney General from 'elsewhere' in the world and he was nailed in Morris county, a libtard stronghold. He may escape jail time if Nappen can make it happen but it is going to be a VERY expensive lesson. Best of luck.

Or how about the darling of the right “I think eminent domain is wonderful” . He uses the guns of the state to take the small man’s land, or ignoreing the law of the land and Congress, he makes it a felony to own a piece of plastic. BYW, what crimes had been committed by set plastic?

I only have the grapevine (read as rumor) version.
He had the final hearing before the judge last week, and was told he was going to walk. Da judge let one violent druggie walk after another, until he got to my BIL. Convicted him of a felony (I must verify that), 3 years probation, 300 hours of community service, the $10K lawyer charged him $15K and showed up 45 min late.

I now taste vomit every time I see a NJ tag in the South.
Please now, none of y'all yanks take offense, but PLEASE do change those tags, at least for the sake of our blood pressure.

Well he's not in jail so he has that going for him. Sucks big time and lawyers aren't held to the same times as the defendants so I'd say 45 minutes is actually pretty good. When my wife was in Practice she would be the first attorney in the courtroom including the ada's about 9/10 days. That often blew up in her face being called back at 2-3 pm for some loser that showed up 5 hours late. Most attorneys won't show up until she 11 am or so.

Damn, that’s pretty crappy BUT at least he’s not in jail! Unfortunately, I believe that felony will cause him a lot of issues with his CHP and ability to purchase firearms. He should look into getting it expunged as soon as possible.
 
I'll never go up there to any of those states. I did go to PA to buy a Jeep and attend a wedding the past few months. But that's as far as it goes for me.

States in the north are hostile foreign lands as far as I'm concerned.
 
Convicted him of a felony (I must verify that) if that is true that sucks on the ability to own a firearm and some possible future job applications, 3 years probation not that bad unless he has to report physically to a PO in NJ or here in NC (NC does Courtesy Supervision pretty much all the time but will NJ allow the transfer) , 300 hours of community service that’s going to being a lot of weekends in NJ and depending on what service(s) he performs and where he’ll have to suffer that indignity.

As Cowboy said at least he’s not in prison but NJ screwed the “slow talking, dim witted, gun crazy” Southerner all they could to show him how they do it up there ...

A bs conviction. Seriously anyone with half a brainstem can see that these infringements are total bs. Why should a state like ours even recognize such a declaration? Seriously, our state should outright ignore it.

Well that sucks. Glad no prison time.

I left NY in '74 and I have never ever thought about going back to live. Went back several years ago for a wedding and that's it. Do not miss it at all.
