Home invasion hits family friend

Happy ending that had a potentially sad and terrible outcome. My 17 year old son has been armed at home when alone since he was twelve. This is just another reminder to keep your head on a swivel when leaving the house. Great job on Mom's part.

Jordan was always armed up when at home. But the one thing that her mother always worried about wasnt that if someone broke in, it was what if Jordan has to shoot someone. How does her baby handle the aftermath
 
I admittedly skipped the legality tennis match, but I need to know if I should leave my surveillance cameras on when/if my home is invaded.

I don't have any cameras for LE to look at after the fact. I wonder what the outcome of the Zimmerman/Martin or OJ case would have been if the incident had been caught on camera?

You understand case law and how that works, right? @Prosecutor you care to chime in with how castle law is generally interpreted in NC?

The so called "Castle Doctrine" is set out at G.S. 14-51.2.

I recommend that folks read it. It's primary purpose is to establish a REBUTTABLE presumption of "fear of death or serious bodily injury" in the home, motor vehicle, and workplace. Further, the statute defines the relevant terms and sets out exceptions and limitations. That's all.

This is an incredibly complicated area of law...these statutes do not wrap everything up. Just the basics here.

Any place you have a right to be is any place you have a right to be. If I'm walking down a public sidewalk, I have a right to be there. If I'm trespassing, I don't have a right to be there. If I'm shopping in a store open to the public, I have a right (by the good grace of the owner) to be there. If I'm "shopping" in the same store after hours, I don't have a right to be there. It's pretty simple.

I have found that before taking strong subjective positions it is worthwhile to hang out and learn all the colorful and extreme personalities here. That accomplishes two things... a) the membership knows you better and you become somewhat of a known quantity, and b) you know them and understand some of the replies as just "business as usual".

You're a car guy, it's no different than on the car forums. Although they tend to be more stupid when it comes to guns and politics. I spend a ton of time on a site with 163,000 members, some who have been there 15 years. You've no idea what a stupid gun debate looks like till you get on a car forum.

In NC there was a case we assisted the unneeded defense in. Very rural isolated farm. Soon to be deceased felon walked in he farm house slapped the two kids ages 3 and 4 to the floor and drug and beat the mom all thru the house. She fought with all her might and stabbed him and bit him and drew blood. She outlasted him by sheer guts and adrelanine. He was fat and over weight. He hurt her so bad, she gathered the kids and dragged them upstairs.

His last words on earth were- "I'll be back". She shot him in the back at 150 yards with her .243 deer rifle from upstairs. Husband heard the shot and came home from the fields and was sure someone was dead seeing all the blood. He had entered from the back door, and ran up stairs. She simply pointed out the window to the front path. There the felon was dead as could be.

DA declined to prosecute, she was certain he would be back. She required overnite hospital stay, plastic surgery and several operations. Kids, they are doing fine. All politics are local.

By my understanding, Castle Doctrine and Stand your ground are two entirely separate things, so under your roof or curtilage is irrelevant. That said, If I return to my residence after my child has called me saying someone has broken in, park in my OWN driveway behind a vehicle I don't know and then ventilate the person driving close enough in my direction to sideswipe my vehicle, there is not a jury in NC or SC that will vote to convict. That's not re-initiating an encounter while the bag guy is trying to escape. That is employing deadly force to stop a violent attack. They may have discontinued efforts to unlawfully enter the residence, but they surely haven't stopped offering deadly force as they drive a vehicle at you. Even if the law requires one to attempt to retreat before using deadly force and no castle doctrine or Stand your Ground law exist, there are always caveats that add "unless retreat is not available or would increase your probability of injury or death" Trying to run from an attacker in a car is the definition of that.

First off - I hate a damned thief.

Being broken into is a fear of mine. One of my biggest worries.
Glad to hear the son is ok and the mom wasnt hurt as the scumbags exited the driveway.

I hope they catch the jerks.

Can you tell us where-abouts this happened? Don't want specific addresses or streets etc but general locality would be great.
Also any kind of bad guys car description? I go everywhere. I see everything.

I bet that hurt, and hey girl nice shot. Some people need killing, and that dude was one.
