Bird in hand versus two in the bush as they say. The county’s insurance company offered a settlement which was probably cheaper that litigation.

That is about the amount I will likely gross (as an engineer my salary is above average but not exorbitant) in terms of salary between now and retirement so it’s not out of line in that regard for most people of middle age. Then there is net worth of assets and growth that is lost.

Yes, it’s probably a fair dollar figure for a lot of people.

As of this case settlement was the insurance company not wanting to put anymore time in to fully win the case, Which they would have eventually.

The decision to settle was taken completely out of the hands of county officials and others involved in the case, according to officials.

The Defendants have specifically denied liability and entered into the settlement only to avoid the expenses, delay and the uncertainties of continued litigation,” according to the judge’s order approving the settlement.
 
Costs to litigate? We spent 20% of that settlement pursuing a guy through an adversary proceeding in bankruptcy court and it never made it to litigation.
 
The taxpayers shouldn't be paying a dime for some drunk redneck that thinks he can do whatever he wants. Does anyone here think that they would have gotten such a settlement from him if he had killed one of their family members while driving drunk?

Yeah federal court has a different dollar rate than state court for attorneys. My guess was this was the lowest the family was willing to go and the highest the insurance company was willing to go without a trial. My best guess is the dollar amount settled on would be what it would cost to do the rest of the trial for the defense. Pretty common for big companies to settle once the see the people are willing to go to trial. Honestly I'm surprised we even heard a thing about it and there was no NDA.

You can get tazed TWICE, maced and hit by a baton and you can still savage your average deputy to the point that their only defense is to shot you. While the guy obviously needed to spend a lot of time in jail thinking about what it means to drive drunk and potentially kill innocent people, there has got to be some ninja jitsu training that these cops can undertake to put down a threat that only has a short weapon (not a knife). Stun guns appear to be ineffectual as does pepper spray.

No, if the moron had just stopped and taken his DUI like a man he would still be here. If this had been a young black man driving drunk, not stopping for blue lights and then resisting and attacking LE, you guys would be ready to hang him.

Did not know the gentleman, but as I live in Stoneville and work in Madison, when this case was hot, it was the topic of conversation and spoke with quite a few folks that knew him. From my understanding @SPST hit the nail on the head with his drunk redneck post. If they had allowed it to be litigated, I do not believe the family would have received any monetary settlement. In this case I think the LE had it right and my understanding is he set the dog on the officers and it was actively biting one in the crotch when it was shot.
 
Stop was wrong to begin with. Guy committed no crime but the cop was fishing.
Driving drunk was illegal, but since cop had no reason to actually stop him, a lawyer probably could have had the case tossed based or at least greatly bargained down. So failure to stop was dumb.
That's when things got out of control and everybody went full stupid.
 
Better him than any non-intoxicated citizen he didn't gave a damn about killing when he crawled behind the wheel.

The dog, I couldn't say, but I can guarantee it was more than this drunk driving POS.
