A police officer who was charged with murder for shooting an unarmed man in a hotel hallway was reportedly rehired temporarily so he could collect a pension, local media reports.

Philip Brailsford, who killed Daniel Shaver at La Quinta hotel in Arizona in 2016, reportedly came to the agreement last year with the Mesa city manager's office.
This allowed him to apply for a disability pension on the basis of a medical retirement in a reversal of his firing by the department after the shooting.

He will receive a lifetime pension of around $30,000 per year.

Reading the comments on the video, there was not a single positive comment. I normally side with LEO, as most are ok people. This guy was a loose cannon, giving confusing instructions and threatening the victim. The victim was stressed, confused, and didn't seem to pose any threat, other than his pants falling and flashing everyone. I am not LEO, but many of my friends are. None of them would have handled it this way. The one, big, common thing they ask is, why did the cops have them crawl to them? 2 cops, so there was cover. Worst case scenario, after the female was cuffed, why didn't they simply have one of the officers... or both... go over and cuff the guy where he was? So he was acquitted, that I understand (don't understand why, but I understand he was), but to allow him to rejoin the force, claim PTSD (stemming from the fact he shot an innocent man IN COLD BLOOD), draw a pension? The victims family should sue for that pension, so he gets nothing. HE caused the situation by being a gungho moron.

Want to hear the worst part? The shooter wasn't the one giving the orders. It's my opinion that is what kept him out of prison.

I'll say it again, and I'll get grief for this but professional law enforcement should not be allowed to serve inked head to toe. I'm quite sure this is a recent development given the inability to hire top individuals. Sad state of affairs that we are giving fast food workers the power over life and death. This guy would otherwise be a mediocre worker in the food service industry.

No, the city has also fleeced the taxpayers for a 3 million dollar fund to cover civil lawsuits the murderer may face....
 
I know a lot of cops and I don't know of one that wasn't disgusted with what happened here.

I don't understand the bureaucratic BS that allowed this guy to be rewarded for one of the biggest screw ups in recent history but that's where a bright light should be shined.

The victim's family should sue to have those payments automatically sent to them.

No person in this state shall be subject to civil liability for engaging in conduct otherwise justified pursuant to the provisions of this chapter.

If he was found not guilty because the jury believed that he believed the guy on the ground was going for a gun, is there an argument to be made that "a reasonable person would believe that deadly physical force is [was] immediately necessary to protect himself against the other’s use or attempted use of unlawful deadly physical force" (13-405. Justification; use of deadly physical force).

North Carolina has similar law (§ 14-51.3. Use of force in defense of person; relief from criminal or civil liability.)

The fact that he was charged and tried might take the "justified conduct" off the board and they could sue. A not guilty doesn't mean one is innocent.

I really don't know if it would fly but they should try it anyway.
