A certain online personality that shall remain unnamed claimed that in some jurisdictions people have been charged with assault with a deadly weapon when they applied pepperspray in a confrontation while also being armed with a firearm without using it.

Does that seem plausible? Anybody seen an actual case?
 
I know it's a felony to use it offensively in a lot of places. NC is one IIRC. But using it instead of a gun? Not buying it. Maybe with a nutcase DA, but let's be honest, those are not that common. And there is a difference between charged, tried, and convicted too.
 
Don't know about the above case studies. But, I think carrying a range of spectrum of force options problematic. We are not LE and do not have an obligation to engage others in multiple scenarios that might require varying degrees of force or use of compliance tools. It also creates complexity in decision making. Don't use this tool or that tool? Will this tool be sufficient? What if choose the wrong tool? What if it escalates? Can I transition from this tool to another tool? How will I do that in the middle if a dynamic situation? (Fight) Where will I carry this tool? It may also have legal complications. You were carrying pepper spray, why didn't you use it first?
Choosing to go to gun and doing so effectively is already a difficult proposition. To think that you have time to make a carefully considered spectrum of force decision from your tactical utility belt is misguided. It's better to simplify decision to either the situation requires lethal force or not.

Just my perspective.

I started carrying the spray when I was OCing because I realized that if somebody walks up to me and says "give me your gun!" I can definetly not yet use it. He starts hitting me I can not yet use it if he is unarmed. At some point of getting beaten up that would change I suppose.

If he manages to take it from me I would be justified in using my gun but … I think the problem is obvious now.
