    It is not against the law to carry and wear a mask. The law has always allowed it.

    § 14-12.8. Wearing of masks, hoods, etc., on public property.

    No person or persons shall in this State, while wearing any mask, hood or device whereby the person, face or voice is disguised so as to conceal the identity of the wearer, enter, or appear upon or within the public property of any municipality or county of the State, or of the State of North Carolina. (1953, c. 1193, s. 7.)



    § 14-12.11. Exemptions from provisions of Article. (a) The following are exempted from the provisions of G.S. 14-12.7, 14-12.8, 14-12.9, 14-12.10 and 14-12.14: (1) Any person or persons wearing traditional holiday costumes in season; (2) Any person or persons engaged in trades and employment where a mask is worn for the purpose of ensuring the physical safety of the wearer, or because of the nature of the occupation, trade or profession; (3) Any person or persons using masks in theatrical productions including use in Mardi Gras celebrations and masquerade balls; (4) Persons wearing gas masks prescribed in civil defense drills and exercises or emergencies; and (5) Any person or persons, as members or members elect of a society, order or organization, engaged in any parade, ritual, initiation, ceremony, celebration or requirement of such society, order or organization, and wearing or using any manner of costume, paraphernalia, disguise, facial makeup, hood, implement or device, whether the identity of such person or persons is concealed or not, on any public or private street, road, way or property, or in any public or private building, provided permission shall have been first obtained therefor by a representative of such society, order or organization from the governing body of the municipality in which the same takes place, or, if not in a municipality, from the board of county commissioners of the county in which the same takes place

    See...I’ve already got this figured out...

    I do not intend to wear a mask in public unless it is at work (required) or at a private business I choose to patronize that requires them.

    After this all passes and “they” determine it is no longer required of folks to wear a mask in public, I intend to start wearing one every damned place I go. If I get questioned by anyone as to why I am wearing a mask and/or it makes them uneasy that I am wearing a mask out in public, I’m going to be all, “MFer!!!! I’m trying to protect myself and stay safe...don’t you dare question my decision to protect my health!!!!!”

    So far, I haven’t read a thing that supports the assertion that the law has been modified. That would take an amendment of that statute by the House and Senate followed by signing of the bill by the governor.

    So far, all I have read is this person or that saying that masks for health reasons are okay or that they won’t enforce the law against carrying while masked.

    I wonder if we would have had a shutdown if the entire Council of State, every legislator, all their aides, etc. were not paid during the shut down, with no back pay on reopening?

    The place I’m going is a bar, can I open carry in a bar if I’m not drinking?

    email I got from sheriff association said Aug 1 2020 (as of this morning)...will post full text when I’m at computer...

    I believe it was an attempt to encourage people, but quite frankly was just confusing and made me less confident in wearing a mask and carrying simultaneously.

    it sounds like everyone doing so before may something was breaking the law lol. And you would need to constantly keep track of dates and changes in order to maintain legality...I’ll pass.

    Just as an aside, I am printing up, and will laminate and put on a lanyard, a badge which reads "I am exempt from requirements wearing a face covering" I will print it up in blue with some kind of NC-120128-22 or such like crap at the bottom, with a bar code scan symbol, and wear it in public establishments. I will bet money NO ONE will call me on it.

    Questions have arisen about information circulating on social media regarding the ability of persons with a valid concealed handgun permit to carry a concealed handgun while wearing a mask.

    Summary
    There is no law in North Carolina that specifically prohibits a person with a valid concealed handgun permit from lawfully carrying their handgun concealed while wearing a mask.
    However, wearing a mask by anyone in some circumstances is a misdemeanor and in other circumstances it is a felony. A person who is convicted of a felony will have their concealed handgun permit revoked and will not qualify for the issuance of a new concealed handgun permit. A misdemeanor conviction will have no impact on a person’s concealed handgun permit.
    Wearing a Mask in Public is a Misdemeanor
    G.S. 14-12.7 through G.S. 14-12.10 make it a Class 1 misdemeanor for a person to wear a mask on any public walkways or roadways, while on the public property of State or local government, while holding meetings or demonstrations, or while on private property without the prior written permission of the property owner.
    There are limited exceptions that allow masks to be worn for traditional holiday costumes, persons engaged in trades and employment where a mask is worn for the purpose of ensuring the physical safety of the wearer, etc., in theatrical productions including Mardi Gras celebrations and masquerade balls, in civil defense drills and exercises or emergencies, while riding a motorcycle to protect the rider’s face, and other limited situations.
    Wearing a Mask While Committing Certain Acts is a Felony
    G.S. 14-12.12 through G.S. 14-12.14 make it a Class H felony for a person, with the intent to intimidate, to: (1) wear a mask while placing or causing to be placed a burning or flaming cross (whether real or simulated) on the property of another, on any public property or on any public street or highway; or (2) place any exhibit (such as a noose for hanging) anywhere in the State while wearing a mask.
    The limited exceptions to the misdemeanor offenses described above DO NOT apply to these felonies.
    Senate Bill 704 Temporarily Authorizes Masks in Public for Health & Safety Due to COVID-19
    With the enactment in May, 2020 of Section 4 of Senate Bill 704, a person is now temporarily authorized to wear a mask in public and on private premises (such as in a shopping mall) for the “purpose of ensuring the physical health or safety of the wearer or others.” The person wearing a mask for health or safety reasons must remove the mask upon the request of a law enforcement officer during a traffic stop (including at a checkpoint or roadblock) or criminal investigation.
    This temporary authorization only applies to the misdemeanors described above but DOES NOT apply to the felonies described above.
    This temporary authorization expires on August 1, 2020. If the General Assembly does not extend this temporary provision of law, it will again be a Class 1 misdemeanor for any person to wear a mask in public (including those with a concealed handgun permit whether or not they are carrying a concealed handgun) unless one of the other exceptions described above applies.
    Ability to Keep a Concealed Handgun Permit With a Criminal Conviction
    Per G.S. 14-415.12 and G.S. 14-415.18, a person with a North Carolina issued concealed handgun permit that is convicted of a felony, including the Class H felony offenses described above, will have their concealed handgun permit revoked and will not qualify for the issuance of a new concealed handgun permit.
    If a person with a concealed handgun permit commits the Class 1 misdemeanor offense of wearing a mask in public after August 1, 2020, that person would still qualify to possess the concealed handgun permit unless the judgment or condition of probation issued by the court prohibits the person from possessing a firearm.

    There is no law that prevents you from wearing a mask and comcelaed carry. The post earlier was from Chad who teaches all nc chp instructors.

    Here is his response. Quoted from the email with his permission.

    "Our citizens ARE allowed to carry concealed while wearing a facemask.

    It’s all urban legend BS but here is the statute. This statute is so people with nefarious intent only cannot conceal their identity and has specific exemptions for safety, etc…..Tell those idiots on Fakebook that I said knock it off with spreading this crap. We have people with chronic illness like auto-immune disease who have to wear a mask in order to live and they legally carry their concealed handguns. You can quote me on your postings and tell them who I am.
