Need some advice on helping my BIL

Long story short my BIL lives in VA and recently had all his paperwork go through for a supressor. Given the political climate/attacks on the 2nd going on in VA he is interested in giving it to me/selling for $1.00 for safe keeping. What would be the best way to handle this. He will pay for all stamps etc.
 
I thought this was going to be about your sister/his wife driving him mad and you need us to smuggle him somewhere...

why get rid of suppressor NOW? Seems silly IF he actually wants it to bother being. So proactive. NFA stuff is federally legally and even if VA banned NFA items he would have opportunity to transfer to you then.

right now it’s better that more NFA items ARE registered in VA as the numbers are an unspoken voice behind the scenes

And is this the only NFA item involved?
 
If it was me (in his position), I’d transfer it into a single person trust with me as the sole Responsible Person (ATF term). That’s a $200 Form 4, but since he’s the transferor and transferee, he gets to maintain possession the whole time.

If anything actually happens that causes him to need to get rid of it, he adds you as a trustee and you take possession. There’s no ATF involvement for that to happen. Silencers don’t need permission to cross state lines, or for trustees being added after the approval.

Otherwise it’s two $200 F4 transfers/waits to move it from him as an individual to you as an individual (or trust he’s not a part of).

Right now I think he is exploring options in case VA bans them. Better to have a plan in place etc
 
...or don’t wait and add you as a trustee the moment it’s approved. Technically he could add you as soon as he mails the forms in, as he was the only RP at the time of submission, so he never lied on the forms.

Get a trust now, you can both pitch in $100 for a new tax stamp to transfer the item from your BIL to the trust. Buy more NFA items and put them on the trust that has you both listed as trustees.
When the boogaloo comes, you can have your own underground network for suppressors or AOWs. You don't need to give the ATF notice when those types of items are going to cross state lines.

I told him to get a trust when he first mentioned getting a supressor to make things easier but so goes life. Great guy and love him but he is bull headed. He is somewhat fuddish and likely didnt think that anything like this would happen. All he wanted was something quiet to shoot deer and squrriels with.

I think @Jeffncs just used them as well, so he can chime in with his experience as an NFA newbie.

@nchunt101 if y’all need help with the paperwork, let me know. I can walk both if you through it if needed, including photos and fingerprints. You won’t need the ATF’s involvement (other than ordering free FP cards) or any LEO/passport photo place.
 
two cans... now you're getting into a costly lack of foresight.
Some of my NFA items are still in MI with family because I never bothered to file a relocation form. They get bounced around from person to person because I can add/remove people on my trust. Once I finally move them down to NC I'll probably remove the MI family and list NC family...

I just used the site recommended by @BigWaylon Thetrustshop.net was easy to use and literally took 5 minutes to fill out. $50 paid and now I’m waiting for the email with the .pdf attached. I’ll get it notarized at the bank and head to the kiosk or local shop for the real investment.
