Now Ammo Dealers (Cabelas) Can Be Sued For Wrongful Death?

Cabelas is being sued for selling ammunition to a 19 year old. Yes it was .45acp and the Cabelas legal eagles are claiming some rifles shoot the .45acp ammo but the base of this lawsuit puts some case law standing on placing liability on whatever happens with ammo after the sale. How far down the line can liability (and blame) for misuse of ammo be placed ... from the manufacturer to distributor to LGS?

write it up to post-purchase information. I'm sure signs were posted saying it is illegal. It's not like they can physically verify he had a pcc or 45acp rifle. At some point somebody probably reminded him that it was illegal if he was buying it for a handgun.
all these laws are stupid anyway, considering SHALL NOT BE INFRINGED
 
I saw this last night as well. It’s such BS. These attorneys are clearly stretching to try to hurt the gun/ammo industry. While it’s a stretch, I think it does have legal merit because of NY’s ridiculous laws. There are a dozen 45ACP rifles, but I can’t think of a single one other than maybe a TC single shot that would be legal in NY. The ammo is labeled and marketed as pistol ammo therefore it’s use in a rifle is just as much an exception as .308 is in a pistol.

Of course all sensible adults understand that the gas station isn’t responsible for the drunk driver’s vehicular homicide, yet this case moves forward.

On another note, this type of legal activism is a great reason to keep companies separate so that even if Cabelas is impacted Bass Pro will be OK.
 
The core claim in the lawsuit is not whether the product was used for a bad purpose, but that the sale of the product was illegal.
 
Just another way of trying to get the gun / ammo industry.
 
Apparenly the state where it happened there are no legally available 45 ACP rifles (???), therefore Cabela’s should have known it was for a pistol, which is illegal for an under 21 YO.

It's illegal to have a 45acp rife?
Or
Just illegal to sell one?

Customer could be traveling out of NY. If I buy a knife in Walmart and use it illegally to harm a person, can Walmart be liable?

How about if you sell ammo to someone on GB and they use it to harm someone are you liable?

I buy a new car from Tesla, two years later I'm driving reckless and I kill a family of 8 in their minivan. Tesla is GUILTY.
 
They will require us to sign an affidavit that we will use ammo and firearms legally.
