Pistol Brace - What is Going On with It Legal Wise?

It was and is now ALWAYS legal.
The ATFECES has decided their policies are the law, and subject to change depending on their menstrual cycle. They have also decided executive branch gets to make, enforce, and interpret laws.

They are COMPLETELY and UTTERLY wrong (See Marbury v. Madison, 1803. The Supreme Court is the de facto head of the separate but equal branches and has final say when there is a clash.
But when you make up your own laws, why listen to facts?
How is this helpful?

How about now?
You’re still ok. But I’m about to plug my phone in and shut my eyes. No idea what the situation will be when I wake up. Stay vigilant overnight!! 😎

I can brace my pistol against anything I want. Seems like an odd thing to be concerned with 👀🤡

Hey all.
I haven't heard anything about the legality of pistol braces in quite a while. Do any of you know for sure what is legal about this issue?

@Alpha007 Here is a link to the ruling by the federal judge granting plaintiffs’ request for a “STAY” against the ATF administrative rule regarding braces: https://will-law.org/wp-content/uploads/2023/01/ATF-Complaint-Final-PDF.pdf

If you’re disinclined to read any part or all 22 pages of that ruling then, this video is one of MANY which do a good job of breaking down the ruling by the federal court for you:

If you’re disinclined to view the entire video then, this segmentation breaks down the pertinent facets of the legal ruling, covered by the video, for you:

FEDERAL JUDGE STAYS THE ATF RULE “IN IT’s ENTIRETY”

0:00 - "Stays the rule in its entirety."
1:54 - Administrative Procedures Act
5:27 - Common Use
9:49 - Why not 2nd Amendment Based?
12:35 - What happens next? Appeal?
15:41 - Supreme Court Discussion
17:37 - Quote of the Day

Finally, attached is a screen shot of the last page of the judge’s ruling, the second to last sentence of which ANSWERS YOUR SPECIFIC QUESTION, DIRECTLY.

Ok, but is it really, really, for sure ok to get a braced pistol now? Like really ok? Are you one million percent sure?

Really?

@Alpha007 , see attached screen shot - it is about the most concise depiction of the legal morass as I’ve seen. You can also view it via this url: https://www.sb-tactical.com/wp-content/uploads/2023/11/Pending-Litigation.pdf

- I came across it while checking out the latest offering from SB Tactical Brace company:

Call me thick head moron, but I still don't know if it is officially legal to use a brace after all the info you folks have given me.
I guess I am just a Yes you can or No you can't type of guy.

I am not sure if that will be the last word on all of this.
I think the agency is best served by maintaining the current situation. While this is pending a great many folks won’t do what they don’t want us to do out of fear and uncertainty. It’s kinda the bedrock of the agency.

Call me thick head moron, but I still don't know if it is officially legal to …

Nothing wrong with you (or anyone else); tbe pos bureaucrats who are (always have been) laser focused on making law abiding firearms owners “the issue” - to distract the American public from their unwillingness +/or inability to actually prosecute criminals for REPEATEDLY violating EXISTING firearms laws - WOULDN’T HAVE THE LAW-ABIDING ANY OTHER WAY THAN CONFUSED …
