Shooting in New Mexico

Did the guy who got shot die or what happened with him?
I worry for the shooter that on top of the 'normal' legal consequences that the injured will go after him, legally, as well
 
was that the guy with the skateboard that got shot?
Def a guy fighting/trying to fight the man with gun, but I didnt see him with the skateboard in the IG video. Maybe missed it

Just rewatched. 100% the guy with the skateboard that got shot. Goes to swing the board, hits the dude and drops the board about the same time as the guy draws and turns to shoot.

He shot the guy that hit him in the head with the skateboard. However, that guy was NOT the guy who originally had the skateboard. The guy who originally had it is the guy in the green/gray backpack. Somehow after the two chased this man down as he was retreating, the skateboard was transferred from green/tray to black. shooter was struggling with both and black hit shooter in the head with the board's trucks.

the end. the guy who hit him last is also the guy who has some kind of knife or stiletto in his hand in the pic posted.

AFTER busting dude in the head with it.
after the shooting, shooter goes down with his hand on his head and is probably suffering a concussion.

so yeah. if you watch the full video, we're missing at least a few seconds where green/gray lost the skateboard and the other guy started swinging it. you can definitely see something else (knife?) still in his hand after he busts the guy in the dome and drops the board once he realizes that the guy ALREADY HAS a gun in his hand that he's hesitating to use.
 
New videos show it better than the first one I posted. Good shoot. He was trying to retreat, got knocked down limiting his ability to retreat, assaulted with a deadly weapon; I would say that he acted reasonably.

The New Mexico da needs to drop his charges and arrest the person who got shot.

There is now 2 sets of laws so all bets are off.
 
I think this guys biggest barrier (beyond current public sentiment) will be when he threw that lady on the ground (AKA assaulted her). If you consider it all one "incident" then he seemed to be the initial aggressor.

I also think that a jury may assume that he went to this rally to pick a fight and people that don't carry 24/7 may think that he brought his firearm with intent to use it.

Obviously he has the right to go where he wants and say what he wants on public property AND be armed, BUT his case would probably be MUCH stronger if he protested non-violently.

Of course maybe another 5 hours of footage exists that changes this again...

Even if he was the initial aggressor, by retreating and trying to avoid the fight he would have regained his innocence. Plus there is some question about his assault on the lady as she was aggressively leaning into and assaulting him.

agreed. I'm guessing the prosecutor will argue for one incident and the defense will say that it is two incidents.

Lol, cannot recall what she looked like but she needed more bottom leaning and less shoulder for my tastes.

Heavily armed racist white men went to intimidate peaceful protesters, then started trouble and shot an innocent person.

We don't know all the details yet and some of her statement could even be correct, but the guy had retreated and was still being attacked by 3 people. at least 2 of which were passing a blunt impact weapon around to hurt him with.

I wouldn't call the destruction of a public monument a peaceful protest. However, I know the mayor probably claims a group on nuns were singing hymns, when they were violently attacked.

We don't know all the details yet and some of her statement could even be correct, but the guy had retreated and was still being attacked by 3 people. at least 2 of which were passing a blunt impact weapon around to hurt him with.

Seems like a weapon to me. Or maybe just a water bottle purchased at the nearby convenience store ? Anyone remember Charles Bronson sock full of quarters from Death Wish.

If spitting on someone can be considered battery then I'd say backing up and blocking them with your arms can be considered battery as well.

but if you'll be willing to upgrade from at least one to at least two, i'll be willing to upgrade from at least two to at least three, because i had not previously noticed what looked like a brick in the young lady's purse.

I couldn’t tell from the couple times I watched it whether only one person was yelling that or if more were. Either way, it looks like a clear case of self defense to me, regardless of his wisdom in being there. The threat to his life was clear.
