Last Sunday I met a forum member in High point to consummate a deal. After meeting him LJ and I wandered up into Kernersville (we used to live there) to see the old house and have lunch at a favorite spot.
We parked at the little cafe and I made sure Lucy had plenty of ventilation and the temps were cool enough I didn't leave the AC running. We were inside about 10 minutes when Barney showed up and we had the following encounter......

Dear Mayor Morgan,

On Sunday, July 29, 2018 at 12:15 pm I had occasion to visit your fair city and was enjoying lunch at Mickey’s Café on Mountain Street when I was called outside by one of your police officers, (Officer xxxxxx) because he had received a dispatch to investigate my dog being inside my truck. Even though the outside temperature was only 79 degrees at the time he said he was concerned about the dog being inside the truck.

Upon exiting the restaurant, and as prescribed by NC law, I immediately informed Officer xxxxxx that I was in possession of a concealed handgun to which he asked what type handgun I had. I questioned the need for him to know this and never received a reply. He then began questioning me concerning the dog and I assured him that the animal had ample ventilation and was in no danger as the temperature was relatively low (79 degrees) and we had been in the restaurant less than 10 minutes.

He continued asking a line of questions that were in no way related to the original call and investigation and when I refused to answer those questions he became very agitated. When asked if I was being charged with an offense he said that he could charge me for several offenses. At this point he asked for my drivers license which I provided. He then went to his patrol vehicle and ran my information for wants and warrants which came back negative.

Upon his return I asked if I was being detained or cited and he said that he hadn’t decided yet. He asked if I wanted to speak with his Sargent and I declined as I saw no point. He continued with his unrelated questions and I continued to not respond to any of them as they were not relevant to his investigation. Finally, he returned my license and then drove his patrol vehicle across the street into a parking lot and sat and waited for me to leave Mickey’s.

Upon my departure from Mickey’s parking lot he immediately began following me down Mountain Street and as I turned onto Highway 66 he continued following me. Obviously frustrated he followed me all the way to Interstate 40 before he ceased. I suspect that he was responsible for the unmarked Forsyth County Deputy that began following me from the Highway 311 entrance ramp onto Interstate 40 all the way into Davidson County at the Childress Vineyard exit.

It’s officers like this that destroy all confidence that the public has ever had in them. Officer xxxxxx’s lack of interpersonal skills and professionalism when dealing with the citizens of Kernersville and the public in general don’t reflect a very favorable light on the City of Kernersville.

By noon on Monday I had consulted with my attorney to get his thoughts on the matter. He felt it should be handled by a letter to the Mayor, NOT the police chief as it could be swept under the rug into oblivion. I drafted the letter, he reviewed it, I made his suggested modifications and sent it to the Mayor and all of the Council Aldermen late yesterday.
By this morning I had received replies from the Mayor, the Police Chief, and 2 of the 5 Aldermen. The Chief's response says that it's being referred to Internal Affairs on Monday morning. Maybe Officer xxxxxx has a track record of such behavior??
 
Good no place for over aggressive officers(Physical or charges) on the street. We had one in my county write 57 traffic citations to three people at one stop. Word is that won't happen again.
 
Sounds like most of the cops I've dealt with here in Kvegas and Forsyth county.

I am looking forward to leaving this area.
 
Karma maybe slow but when it catches up with that idiot, she's going to be a real bitch.
 
What about the thin blue line? Didn't you tell him that you were former GSP? I thought all you guys looked out for each other?
 
I don’t always like @Bailey Boat ’s posts, but when I do it’s because he called out K-Vegas PD Barney.

It’s a small town that’s fairly boring and the cops need something to do. My friends in high school were questioned near sunset at 4th of July Park by K-Vegas pd. 10 sweaty guys on a basketball court with a basketball and Barney’s opening question is something along the lines of, “Hey, what are y’all doing out here?”

Wife's dad lives on the Winton-KVegas line on Union Cross rd. I haven't had the opportunity to meet any of their fine local LEOs but I'm glad you tuned one of them up nicely Bill :D
 
I might be treading on thin ice but it sounds to me that we just had a clash of personalities/egos here. You said something that struck him wrong so he did the same and it went on from there. I wasn't there and inflection means a lot but my first thought was that if a cop asks me what kind of gun I'm carrying that's an olive branch to ease the tension and establish common ground.

Regardless the cop did act unprofessional, but he might not have, having been treated differently. In my encounters with LEO I treat them with the utmost respect. Whether you think they deserve it or not, it's the smart thing to do IMHO.
 
If it was 80 degrees outside the inside of the vehicle could easily been 100 even ventelated. I wouldn't be so high and mighty.
The amount of sunshine has more to do with it than the outside temp, unless it's downright cold. 79 and overcast no problem, 79 in full sun and we've got a problem.
 
So a local PD runs in the the prickly @baileyboat and their is a clash. Not shocking. But I would hope that officers are trained and have dealt with all sorts of people, and are wise and calm enough to be the better person and let it go. Especially when there is no crime occuring. Sounds like this officer had to 'win'. Hope he gets properly corrected.

Maybe it's an age thing, @Bailey Boat and I are pretty close to the same age. When he asked what kind of gun I had, I would have given him the same answer. The part that would have really bothered me was when he asked why are you in K'ville, where are you going, where have you been? Last time I came through K'ville, they had open borders. The cop was on a fishing trip.
And, if anyone has paid any attention to Bill's posts on here you would know that his dogs get the best of care and attention. In my opinion, Bill's dog was in fine hands.
 
So being “high and mighty” means not submitting to police authority over nothing? If the dog had been in real danger then this officer could have followed through on his multiple charges.

Cop went on a fishing expedition, had no hits, then acted like a spurned crazy ex girlfriend who didn’t get her way.

But what would a “cops messed up” thread be without the boot brigade marching in. Even in one written by a former cop himself.

yes they do.

but honestly - they arent quite as good as they used to be (for the last few months anyway) . i think they need to replace their summer help or something - cant get orders right, food doesnt seem as fresh. if you catch them on a good day burgers and fries are good - the hot dogs are always good though.
 
You could've watched in your rear view for him to make a mistake like not using a turn signal or something similar and then promptly stopped your truck and became this guy:

I'm not one to be deliberately antagonistic of police officers, BUT I am most certainly NOT above some deliberate finger-poking in full view of such an officer as described.

For example, I could easily picture myself having an extended stay at Mickey's Cafe. Maybe going outside for a bit to enjoy a soda and ice cream with the dog. Wave at the kindly officer sitting in the lot across the street for hours. Screw with his mind a bit, say, by leaving the restaurant out of his sight, circling around the block, then walking across the street in plane view back to the restaurant/car.

Get in my car, back out, then park in another parking spot.

Get in my car, pull out, park the car in front of the nearest store and go inside. Repeat...driving to the next nearest store/shop/restaurant, even if it's right next door.

There are a TON of time-wasting things I could think of doing to entertain the officer.


About the actual questioning? I don't think I'd be rude, but I'm old enough now not to be as open as I would have been in my younger years for some of the non-relevant questions. No lies, mind you. That's never good.

3. When I first got this truck in 09 I spent 125.00 having the ECU re-programmed so I could lock the truck with the engine running
in case I wanted to leave the AC or heater on if I had a dog in the truck. That particular day was 79 and fully overcast. Lucy was never in any danger nor discomfort. She is certified and I could have brought her into the restaurant had I chosen.
4. His attitude was the bar that set mine. I learned a long time ago that you reap what you sow. He came off with a condescending attitude toward me and I returned the favor. "My attitude is a direct reflection of yours".....
5. I am not a "subject", I have rights afforded to me by God and the constitution, I know what they are and I'll be damned if you're going to run over me. He wanted to treat me like a criminal and I wasn't having any of it that day, or any other day.
6. His line of questioning even got to the level of "Is this your real name"?? Can you prove it??" Really?? I mean really?? Who in hell can "prove" their name on the spot?? Then he questioned my address, "you haven't moved since this license was issued??" Throughout the encounter I maintained a level tone of voice, I don't have a popping vein on my neck and I think that may have been what aggravated him.
PS: I have received return email from the chief which states that the matter will be turned over to Internal Affairs which tells me this isn't the first complaint of this nature that Officer XXXXXX has received. Otherwise the Chief would be handling it.

I've learned over the years that CORRECTLY corresponding with the CORRECT person is more likely to result in a positive action.

I talked with some friends that still live in the area and they tell me that the Kernersville PD has been, and continues to be a problem and that they are hoping the new Mayor is going to clear up. We'll see.....
 
But when did the well being of animals become a priority for the copers?

Don’t they have some badguys to apprehend?

youd think theyd be busy chasing down the heroin addicts driving around and falling asleep at the wheel, or the folks driving down west mountain st after having too many cervezas.

priorities i guess.

I figured as much. I've had most all of my dogs certified as ESA's. Not to have them anywhere but in a motel/hotel room with me when I travel. I used to take Bailey to the Midwest to hunt and it gets cold as heck at night in Nowhere Kansas....
I don't take them into restaurants or onto airplanes, that's why Lucy was in the truck to begin with.

Just a point here:

There is no such thing as a "service cockatoo". A service animal is a DOG trained to do work or tasks for a disabled person. A service animal CAN also be a "comfort animal", in terms of emotional support.

HOWEVER...a "comfort animal", "emotional support animal" or "therapy animal" is NOT a "service animal", as they're only providing "emotional support". And any other animal OTHER than a dog cannot be a "service animal" per the ADA.

The definition is found under Title II and Title III of the American Disabilities Act. From the following site:

A service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability. Tasks performed can include, among other things, pulling a wheelchair, retrieving dropped items, alerting a person to a sound, reminding a person to take medication, or pressing an elevator button.

Emotional support animals, comfort animals, and therapy dogs are not service animals under Title II and Title III of the ADA. Other species of animals, whether wild or domestic, trained or untrained, are not considered service animals either. The work or tasks performed by a service animal must be directly related to the individual’s disability. It does not matter if a person has a note from a doctor that states that the person has a disability and needs to have the animal for emotional support. A doctor’s letter does not turn an animal into a service animal.



To be sure, you'll likely be viewed as a dick to argue the point with Ms. Cockatoo...but then, I've found this isn't generally a problem with the people on this site.

Way back when I got Bailey's cert I had to send in a video of her performing while I gave her off leash commands. With Lucy it was a matter of paperwork and $$$$, no video required.
With both dogs my only goal was to be able to take them into a hotel room while I spent the night, no restaurants, no air travel, nothing but the hotel room. Both dogs were "alarm" animals and since I sleep very soundly the alert is what I need to be safe. Bailey @ 90 pounds could have put up a valiant fight to protect me but Little Lucy @35 pounds is strictly alert trained. If she growls or barks in the middle of the night, I'll take it from there......
Bailey woke me one night in Lenexa Kansas because someone was turning the door knob and Lucy has only awakened me once because she heard something/someone messing with the truck in Arkansas. Both times I responded with gun in hand and took care of the situations.
