Sweeping VA gun ban, likely confiscation without grandfather clause, proposed by state legislature

"Virginia lawmakers are now considering a state law banning the ownership of certain semi-automatic guns deemed “assault firearms” and limiting the magazine capacity of other firearms in the state — and there are no clauses that would allow existing owners to continue possessing them.
Virginia state Sen. Richard Saslaw introduced SB16, which would expand the definition of an “assault firearm” to cover many different semi-automatic rifles and pistols. The bill would call for the ban of such firearms, barring people from purchasing, possessing, selling or transferring those weapons.

Among the changes in firearm definitions, the bill would expand the term “assault firearm” to include semi-automatic centerfire rifles and pistols with a fixed magazine capacity greater than 10 rounds. The bill would also ban semi-automatic rifles and pistols with detachable magazines that also have folding and telescoping stocks, barrel shrouds, and thumbhole grips and second hand grips.

Rifles, under the new bill, would not be allowed pistol grips, bayonet mounts, grenade or flare launchers, silencers, muzzle breaks and flash suppressors.
Virginians would not be allowed pistols that accept the magazine into the weapon at any other point than the pistol grip. Pistols would also have an unloaded weight limit of 50 ounces.

The bill also limits shotguns to a magazine capacity of no more than seven shells.

“The provisions of this act may result in a net increase in periods of imprisonment or commitment,” the bill says, indicating increased imprisonments as one likely outcome of its passage.

Sen. Saslaw did not respond to multiple requests for comment by American Military News.

In reaction to the newly proposed bill, the National Rifle Association’s Institute for Legislative Action (NRA-ILA) reported the bill would ban many commonly-owned firearms like the AR-15.

The NRA-ILA also noted the bill does not grandfather in existing owners of the firearms described. Current owners would reportedly have to give up their banned firearms or face a felony conviction. The gun advocacy group described the legislation as “clearly designed to be firearms confiscation.”

Along with the specific items listed to be banned, the law also prohibits “any characteristic of like kind.”

The gun advocacy group described the “like kind” language as “unacceptable vagueness” that would burden gun owners with guessing how courts may interpret the provision and potentially judge components on their firearms.

Violations of the law would constitute a Class 6 felony. According to Virginia law, such felonies may be punishable by up to five years in jail.

The NRA-ILA suggested the legislation is a result of former New York City Mayor Michael Bloomberg’s heavy financial involvement in recent Virginia state elections.

Bloomberg, who officially confirmed his bid for U.S. president on Sunday, has listed gun control as a key component of his campaign platform.

Bloomberg’s Everytown for Gun Safety advocacy group spent some $2.5 million in the election, according to CNBC. The gun advocacy group greatly outspent the NRA’s own $300,000 it threw into the race.

The spending may have played a key roll in Democrats winning control of the legislature for the first time since 1994. The Democratic control of both the Virginia House and Senate along with Governor Ralph Northam may raise the likelihood the bill will pass.

In a statement by Everytown for Gun Safety following the Virginia elections, the organization touted 15 of its endorsed candidates won in the state.

“Everytown for Gun Safety and the Virginia chapter of Moms Demand Action for Gun Sense in America, a part of Everytown, today celebrated the victory of 15 endorsed candidates in Virginia. The candidates were running in key districts against gun lobby-backed candidates in the NRA’s home state,” the Nov. 7 statement read.

Man, imagine the resources the NRA would have to fight this stuff if La Pierre didn't have such expensive tastes.

No doubt the phone calls are coming, asking for your money because the NRA is going to show up post-election to "Stand and Fight."

The NRA "fights" gun control exactly the same way the NAACP "fights" racism.

This is going to be interesting to watch. VA’s population is kinda sorta like the US in that a few blue areas with heavy populations have taken hold and are screwing with a bunch of red areas ... F8CAA129-483B-47CF-9F47-02FDAE4F7BDB.png

Could VA have its own mini-civil war? Almost East vs West with a bunch of friendlys caught behind the blue borders?

I wonder how many candidates Everytown endorsed. It's easy to make 15 sound like a victory but its certainly relative to the total number endorsed.

But, if it was enough to win the House and the Senate, does the number matter?

While controlling the house and senate is the ultimate win, that was not the intent of my question. Having 15 of their endorsees win doesn't make Everytown a powerhouse in politics and them getting their way. Out of those 15, you must also look at who else endorsed the same candidates, who were their opposition, and etc. Now if Everytown endorsed exactly 15 and 15 were elected, that would show they are a force to contend with in election cycles. I was more curious about their political strength rather than the win.

    Edited to add more information

This exact thing happened here, in North Carolina from 1765-1771: the War of Regulation. Rural folk rising up against the Eastern political and economic class.

    It is not without precedent.

But those were hard men; determined men. Men whose existence was very hard, men who clawed a living out of the wilderness.

    Tough times, strong men.

We live in good times....for better and worse.

Every single one of these bastards should have to stand on stage and point out the parts that they are banning on every single weapon they are banning. Doubt anyone could point out a barrel shroud. Or a bayonet lug. Or probably even a pistol grip.

Would be nice to see the rural folk storm the gates and make examples out of these politicians.

I'm not a fan of tar & feather, it rurns the hide for tanning later. But if you intend to just make rawhide chewbones for your dogs it would provide some education for the kids.

Perhaps the states ( VA ) need to adopt the "Electoral College" model.

Although it's not mentioned in the article, we'll probably lose reciprocity with them as well, so no carrying into VA any more. But even if we don't, we'll have to live with the mag restrictions. We'll have to buy a 10-round mag for when we visit the former free state.

You go right ahead. Comply if you wish.

Just because it came out of a politician’s arse and landed on paper doesn’t make legitimate or valid.

They will keep going until something bad happens to them. Simple as that.

After something bad happens they will either ramp it up or retreat. Shrug.

The only question is where it's gonna happen (not when / when is soon).

I imagine whatever backlash occurs will be paraded around as exactly why bans/confiscations are needed.

It will be a full on show, flags at half mast, flags draping the caskets of treasonous fools. Any that were veterans will be proclaimed war heroes, even though they spent all their time Stateside behind a desk. All superficial religious trappings of patriotism, treated every bit as a 9/11 event but by "homegrown white terrorists." (regardless of how diverse gun owners are)

The police will get all kinds of fancy new toys by which they can "protect our democracy" from this new "threat." The last vestiges of the Bill of Rights will be swept away, to thunderous applause. Neighbors will turn in neighbors - even some folks on this forum would likely begin reporting folks. While this third iteration of our happy little band is certainly the most distilled, we still have Fudds here who live a Legal=Good existence.

I suspect it would get really ugly really quick, and the pro-Rights side will start the show without the most important ingredient in rebellion: popular support.

It's vitally important to sustain an insurgency that they enjoy enough popular support to provide a clandestine supply chain as well as safe zones from which to operate, coupled with enough indifference to put the lion's share of the onus of winning hearts and minds on the State.

This is why, as these Red Flags go further, we HAVE to be inhumanly patient as they run their course and as bodies stack up.

We must let the State act in such a way as to make itself a easily painted as the existential threat to American Liberty, and propagandize the hell out of every death.

Show up en masse at the funerals, flags flying. Salutes and hats on hearts.

Exactly like what our ancestors did with the Boston Massacre (after inciting the entire incident, the Sons of Liberty solemnly paraded the bodies, in their caskets to burial, past the governor's mansion and through the streets of Boston, with somber faces and angry looks) and the fighting at Lexington and Concord (they ensured the Regulars fired first - they opened hostilities, and they excoriated them for spilling their fellow subjects' blood while celebrating their own dead as heroes).

The opening act is as much theatrics and drama politics as it is a brave defense of one's principles and Liberty.

Being the clear victim and not the aggressor is paramount when the curtain first goes up. It becomes the moral basis for all the horror that must follow.

The map that was posted way back at the top of this thread got me to wondering. I know that I have been told by neighbors that the areas outside of DC are controlling the state. These numbers can't be taken as absolute accurate because I only do the best I can but I came up with this last night:

There are 94 counties in Virginia,
There are 4 counties in northern Virginia that border each other in the DC area. The population of those 4 counties is about 2,263,177.
From the least populated county moving up it took 59 counties to total 1,001,860
Further, it took the lowest populated 80 counties to total 2,051,186 and you still haven't totaled the population of Fairfax, Prince William, Louden and Arlington counties.

I'm not drawing any conclusions from this because whenever I do something like that many people find flaws in either my reasoning or my math so I'll just put this here for information purposes only.
