Sweeping VA gun ban, likely confiscation without grandfather clause, proposed by state legislature

Unless just compensation is provided, the proposed law is in violation of the 5th amendment of the U.S. Constitution. I don't know how magazine bans that require the surrender to law enforcement without compensation have withstood this.

The state of VA most likely doesn't have the financial resources to properly compensate all of the firearms owners who theoretically would have to be paid which is why such compensation isn't mentioned.

The law is different in this case because the government, as the sovereign, has the power to take property that is dangerous, diseased, or used in criminal activities without compensation.


Now tell me how exactly confiscation of dangerous bump stocks is different from confiscation of dangerous AR-15?

Now we all have quite a few people who ARE criminals and can be stripped their gun rights via laws the majority of pro-2A crowd have no objection about, because they are f...ng felons. Very smart. Let them make stupid law, then disobey these law and become a felon, then get your rights taken. And, last but not least, as a side-effect, get some distrust and disrespect to laws.

That is already the worst case scenario for a law-based and respect-based society. Any law must be either obeyed or must be proactively resisted to the point where it is easier to repeal it than enforce. This is the society based on the law.

Otherwise you just follow liberals' "bla-bla-blah justice" concept - do what you feel is justified rather than follow community contract called law.

It's pretty obvious from the way Washington operates of late that the rule of law is crumbling fast. Even more amazing to me is to watch people blatantly disobeying traffic laws like the apocalypse is already here. People are running red lights like there is no tomorrow. Speed limits are really for the weak. Look around, slowly but fastly, the rule of law is softening to a gooey paste.

Every single one of these bastards should have to stand on stage and point out the parts that they are banning on every single weapon they are banning. Doubt anyone could point out a barrel shroud. Or a bayonet lug. Or probably even a pistol grip.

Would be nice to see the rural folk storm the gates and make examples out of these politicians.

There was a gun group in some other state that actually recorded a politician saying they had no idea what was in the bill - a group gave it to them and it was approved by their handlers, so they sponsored it because guns are bad.

They haven't.
They have been met with MASSIVE noncompliance, to the tune of 95+% of the "expected" number of banned items not showing up. Given the number of people who have things that nobody knows about, it's only technically incorrect to say that there is over 100% noncompliance with them.
Police know they can't go door to door. The only people charged with possession of banned items are people who are already getting a laundry list of charges (often righteously) dumped on them. mag possession is kind of just an add on charge.

Yea, but you won't be able to take it to the range, train with it, zero a scope, or take a 30 round mag out of the house. It could only come out when SHTF. And if you ever get red flagged, you wouldn't just lose your guns, they will drill into your safe and now you'll lose your freedom and your job.

All this sounds maddening and it is. So what about NC? Anybody that thinks forces are not organized in NC to try and do the same thing is kidding themselves.
Is everybody conversing with key Republican lawmakers and giving $$ to pro-gun groups that are currently carrying the flag. Outside anti-gun $$ (bloomberg and soros) can easily be diverted to NC in a heartbeat. They already have the plan in the filing cabinet ready to go.
 
And how many are 3%-ers of 10,000,000 NC population? I suppose something like 300,000 so resistance would be at least... noticeable? ;-)

He couldn't even get 10 let alone a hundred. Be prepared to act on your own. They will kill you and use you for an example why "free men" don't need firearms. This sickens me but I have accepted it. The men of 1776 and 1860 are no more. At least not in numbers that can be effective.....God I wish I was wrong.

They may return but it will take a considerable economic down turn to release men from their familial obligations.

If you ask me, it’s a different group that needs to be put on their knees. Any enforcers that would choose to protect that group are likewise the sworn enemy of the a people and need to be dealt with as such.

That’s the sort of thinking that enables these gun grabs. It’s believing that they somehow have a right or a legitimacy to enact them, to tell The a People they can’t be armed while simultaneously arming their hired agents of force. Apparently they think that because there was a vote or something that it makes it a matter of their or even public majority opinion. They’d be wrong. We’ve lived for too long in a society where there the people have been passive and obeyed and now they want to cross the line. They believe that people will passively hide their guns and play the “please don’t see me game”. They think they’re the only ones who will act with force and violence. They believe they’ll be the ones going to people’s homes. Thry think there will be no repercussions for kicking things off by trying to make a few examples. They’d be wrong.

Of course our side needs to continue to play the game, take it up through the courts, speak out, vote, whatever. Not because those things will be effective, though they might. Still it doesn’t mean that if they're not effective that it would be the end of it. It wouldn’t. It’s just part of the moral side. When the fighting starts, they need to be seen as the bad guy and the aggressor.

Roughly 80% of a guerrilla movement is support and intelligence behind the shooters which is why the moral war is the most important.

I’ve had this conversation with others. It is recognized that the moral standing to fight has been there for a long time now. Personal comfort keeps a lot of people from doing that, but things could be changing. Look at what happened in NY last weekend.

Now we have the threat of gun grabs in VA. I think it will go over there worse than in the NE. At present, it’s still just sabre rattling. If this nonsense passes we shall see what happens. Compliance will be non existent. Legal challenges may bring it down. However, if it doesn’t, those pushing this might not like the results of letting the genie out of the bottle.
 
That wouldn't go over too well in most parts of VA..... especially the western half.

But I'm thinking of getting one big one and one nervous little yippy one, just for the laugh of having potential intruders hear a shrill "yip yip yip" only to be confronted with a dog nearly as big as they are.
Having a dog at our old small house when we were both working long hours would have been cruel. Now my wife, armed as she wants to be, works from home and we have a house 3x as big. she likes golden retrievers, i like shepherds. and chihuahuas.

States? change the bill of rights? by 2/3 of them getting together and having their representatives in the house and senate vote on a new amendment.
Until then, there is no changing the 2A, and ... every gun law is unconstitutional. You can make the argument about compelling public interests, laws that are extremely limited in scope, strict scrutiny, etc... but just passing a state/local law against guns is illegal.
Of equal concern is the number of states that have their own constitutional amendment about protecting the right to keep and bear arms, but don't even bother to give a poop about infringing.

Just because it came out of a politician’s arse and landed on paper doesn’t make legitimate or valid.
Legitimate in your (or anyone else's) mind or not, laws matter and have a direct effect on everyone. Illegitimate laws need to be opposed and defeated beforehand or repealed afterward, not just ignored because you think that you can sneak around under the radar.

You do understand that the only real teeth a law has is the willful compliance of the population, right? And if the majority of the population simply ignores the scribbling of politicians en masse, there’s really not anything the politicians or their hired muscle can effectively do about it, right?
