Under 21yo W/PPP and Gunboker???

A young man (under 21 but has a PPP form his Sheriff) at church tonight asked me how he could buy a pistol off Gunbroker? Since it is coming from out of state it has to go thru a FFL so the BATF’s no handguns under 21 thru 4473 FFL thing comes into play. I told him basically he can only purchase from an individual (no FFL) who is a resident of NC ... I didn’t see a route for Gunbroker for the kid.

I do have what might be a work around but it might border on Straw Purchase ... what if someone has what the kid wants and sells him his for the Gunbroker price and then replaces it with the one off Gunbroker?

I don't EVER break the lW but it seems like some people should follow the Marxist rules. If you can het away with it you should. The ends justifies the means. Or at least that is what the Commies say.
 
You could always buy it from gunbroker and then decide that you don’t want it, or don’t need two, and sell it. Use your money to buy it.

If you send a letter to the AG he’ll probably say that if your intent was to circumvent the law then you’re probably guilty of something. If you care about such things then be sure not to have that intent, or at least don’t post about it on a public forum.
 
Certain circumstances call for the 3 S's. This circumstance calls for the 1 B and 2S's. Buy, sell, shut up. That's all I got.
 
I'd say you're good to go, because the second item that you purchased was not with the intent of immediately transferring it to another individual, so the straw-man purchase wouldn't apply here.

That is my thought ... even though it would be more likely to hit the lottery than ever have the dates even be called into question. The problem is law abiding citizens worry more about the remote chance of just breaking a simple law while true criminal just worry about being caught for one of many they break willingly.

To expand a bit on what Catfish said, you only have to be 18 to get a PPP. However, you can't then use it to purchase from an FFL (due to federal law) which means you can only by from a resident of teh state (no FFL).

I went through something similar getting PPPs in order to legally receive my inheritance from my dad (who was not a NC resident). PPPs are needed for a handful of weirdo legal transactions.
 
My son bought a gun at 18 with a PPP. I didn’t know it was possible until he took me down as he got it from the sheriff.
 
I don't think straw has a lick of anything to do with it... He's legal to own. Just has to buy from FtF in state.

Eta. The grocery store buys out of state to sell to me. I see no difference.

I agree with this. I don't think it circumvents the law as it is 2 separate, legal transactions. He can only buy FTF so this process allows him to purchase without breaking this law. I'm not a lawyer though.
 
IMHO, the story ends with kid buying pistol with his PPP from another NC resident who legally owned it to begin with. What said NC resident does with money is a different story and completely irrelevant to the question.
