"Big box retailer Walmart will no longer sell firearms in its New Mexico stores after a universal background check measure went into effect in the state on Monday, requiring federally registered firearms sellers to facilitate gun sales between private parties.

Instead, the company opted to drop the federal licenses for its New Mexico locations altogether, preventing Walmart from selling guns within state lines.

The New Mexico law, enacted in March after Democrats captured the reins of statewide government for the first time in eight years, expanded background check requirements for firearms sales to include transactions between private parties, a level of scrutiny that federal law does not require.

To facilitate these sales, the new law mandates that federally licensed gun sellers such as Walmart, who are already required to conduct background checks by querying the FBI's National Instant Criminal Background Check System (NICS), assist private sellers by conducting background checks on their behalf."

4 months from passage to running out WalMart. This immediately after gaining control. This makes my 8 year supposition a little clearer. Remember, City by County by State. They are coming. NM quickly becoming one less place for Callies to run to.
 
I couldn't imagine a system that would make NC's PPP seem appealing. :eek:
 
Surely that is going to be challenged in court, and it ought to be overturned.

How can a state force holders of federal licenses to perform services? Can they force FFLs to sell donuts? Give haircuts?

Well they can force you to bake cakes for people you don’t want to. They can force you to have health insurance and de facto force insurance companies to provide services to those people.

We’ve been headed down this slippery slope for awhile. And I totally get Walmart’s refusal to play along. Can you imagine the total poop show it would be at Walmart with everyone coming in to transfer weapons? They would lose their asses money wise not to mention back logging the hell out of the employees.

I suppose the law must have capped the fee they could charge. Otherwise WM could just charge $5000 and it wouldn’t be a problem.

But yeah, clearly the big box stores would have a problem with it. That was almost certainly an intentional feature of the law, not a bug.

"...Put him in a round room and tell him to pee in the corner!" And the Leftists are hyuck-hyucking amongst themselves, for now.

I recall a ruling a few months ago that the fact that the technology did not exist, making it impossible to comply, was not grounds for dismissing a lw requiring "smart gun" technology. There are reports of folks having their property confiscated or being charged for crime A while in the process of complying with law B. The burden of innocence is upon them, let them seize what justice they can afford.

It is naive to think that the people behind these laws are well-intentioned idiots (though their supporters may be). The web of laws is becoming/has become so complex, and the spaces between the sticky fibers so small, that the law abiding cannot reasonably comply. Thus, new criminals are created out of good citizens, who can then be disarmed by law.

Neat trick, huh?
 
IMO, good. Maybe it will get the fence sitters attention when they can't go to WW and get anything because they didn't get involved, or didn't believe this would happen.
 
Just when I think “Nah, I really don’t need to stock up on anything...it won’t get that bad” stuff like this shows up and reminds me that NC is quickly changing in its political leanings and something like this is only a few representatives away from being imposed here.

New Mexico has traditionally been a democrat voting state although previous leaning was towards the old "Scoop Jackson" flavor. The youth of the heavily Latino population has been pulled into the modern leftist democratic party unfortunately with resulting predictable results.
 
Just when I think “Nah, I really don’t need to stock up on anything...it won’t get that bad” stuff like this shows up and reminds me that NC is quickly changing in its political leanings and something like this is only a few representatives away from being imposed here.

I agree. I went directly to SGammo.com for a purchase again only to find my favorite ammo out. And my second fav out. And my third fav out. Matter of fact nothing I wanted was available. But then again I’m picky when I can be picky. But for certain I will be watching and making a couple case purchases just to pile on top of my piles.

Hehe...I have low standards for most of my practice ammo. I’m only picky on my carry ammo.

Can a state impose requirements on a federal licence holder?
FFLs can refuse service to anyone for any reason, according to the BATFU.

What NM needs is an FFL that posts a sign at the entry that says "Background Checks for Private Sales - Go To The Local Sheriff"
 
I have never bought a gun from Wal Mart.
It's not a pleasant experience usually. Requires more than Federal law aka 21 to buy a long gun or ammo now, 4 or 5 manager types to key in what should be a computerized slam-dunk form, and a perp walk out the door. All to maybe save 5% over your friendly neighborhood FFL that needs the sale.

I have always given the reasonable difference to the FFL. Sometimes the FFLs make me find it online and transfer through another FFL...but the good guys are still getting the money.

I’ll look. I’ve stuck mostly to brass ammo manufactured in the world leader of quality and machinery- Germany. MEN ammo brand has been nothing less than outstanding. Sellier and Bellot when made in Germany or the Czech Republic. Not Brazil. Often called bouquet ammo. I call it dependable ammo.
I have never bought a gun from Wal Mart.
Nor I. Walmart’s policy of hooking American branded companies, enslaving them to Walmart orders, and then putting a foot on the vendors neck on pricing resulted in low quality firearms such as Savage, Remington, and Mossberg. BS total plastic guns except for junk barrel and bolt.

They have destroyed the American entrepreneurship.
 
I dream for the day firearms & ammo suppliers cut off gov.co when these egregious laws are passed...….please! start with one and let the word spread!
