What are the laws regarding auto knives in NC

I want to buy a spyderco autonomy and was confused on if i can carry it or not. Some places say i can and some not. Any help would be appreciated

As best I remember his answer when I posed the same question...as long as the pocket clip is exposed, you're probably ok. In my case, the knife clip is covered by the same shirt covering my gun so I passed.
 
I was told that in NC anyone can own one but only full time military personnel ,First responders and law enforcement personnel can legally carry them. I would check the NC Attorney Generals website . Should be listed there
I have been told the same by someone who makes a living of knives.

You think some LEOs aren’t to up on firearms laws, many are worse on edged weapon laws and NC edged weapons laws are pretty vague. Like some will go with certain blade lengths on knives others will go with a fixed blade hunting knife not being in the open in a vehicle an “illegally concealed” ... and then let the courts settle it.

Honestly most LEOs are not going to give a law abiding citizen grief over an auto opener vs an assist opener but if they’re in a bad mood it is an area some will get nasty in. Personally I’ve never had any problem with a LEO and any knife up to an assist opener (don’t own an aut0 opener) I guess because when you inform them of your CHP and so on and little blade doesn’t stand out.

As to the concealing of a fixed blade under NCGS 14-269 ...
14-269. Carrying concealed weapons.

(a) It shall be unlawful for any person willfully and intentionally to carry concealed about his or her person any bowie knife, dirk, dagger, slung shot, loaded cane, metallic knuckles, razor, shuriken, stun gun, or other deadly weapon of like kind, except when the person is on the person's own premises.
... it lists a few types of fixed blades. A stupid thing is our CHP (Concealed Handgun Permit) only applies to handguns so we have no relief there ... or even a stun gun for that matter.

My take is it’s a gray enough area that I ain’t gonna say anymore than the above ...

As battery oaks billy said if they want you they will have you. There is a reason we have the quantity of laws and vague laws we have. At some point we are all probably breaking 10 laws we don't even know about. But when politicians' success is base don passing new laws this is what we get. Where is a political party that wants to eliminate laws? Yeah, still looking for them too. :(

My understanding is that

""like kind"" has been legally extrapolated to include all fixed blades no matter style or length....

I for one don't want to be in court establishing case law regarding "like kind" interpretation

Yep, “case law” is way to open and the way courts rulings ebb and flow like the tides will bite someone sooner or later.

Side note in North Carolina unlike the “Concealed Handgun Permit” statutes there are no true statutes for “Open Carry of a Firearm” ... case law in 1921 of N.C. Vs Kerner aided citizens to open carry. Ironically N.C. vs Dawson in 1966 is used as cas law for the “Going Armed to the Terror of the People” charge ...

Haha True story. I got pulled one time coming home from a hunting trip near Boone. I got behind a Guilford county deputy on the four lane and when he slowed down to 45 mph I didn't pass him so he pulled me for suspicion he said. Walks up to the window asks for licence and registration and asks if I have any weapons in the vehicle. Yes sir the 1100 and the 7400 you see in the back glass and there is a turkey shoot shotgun in that case laying in the extended cab. Is that it? There may be a pistol under that seat over there. May I search your vehicle sir? Sure go ahead. When I open the door he said "WHOA RIGHT THERE IS A KNIFE RIGHT THERE IN THE DOOR PANEL" oh s*** I didn't know we were counting knives too!! Haha he handcuffed me and sat me down in the grass (for my own protection I'm sure) and waited for back up to arrive. Once backup arrived I showed them where my pistol was secured and then they began the search in earnest. They had a huge pile of "weapons" and ammunition stacked in my front seat. They didn't find anything illegal and let me go on my merry way. Your comment just made me think of that incident and gave me a chuckle. Sorry no help on the Auto open knife subject though.
 
My understanding is that they’re legal to own, but a no-no for carry ”concealed” outside of your own home or property. There may be a grey area as to what “concealed” means, i.e.-visible pocket clip vs. not visible.

I tend to err on the side of caution here. My spyderco sage 5 and para 3 open quick enough for me, but I do really like using the 2 pro tech autos I have to open boxes and letters around the house...heh. I’d rather not be a test subject for some overzealous LEO and/or prosecutor. The laws, as written, are certainly vague enough to make me stick with my current spydercos for edc.

So I'm not allowed to carry a stun gun in a backpack in the trunk of my car? Oh dear.....

I think the whole, "automatic" opening knife thing is funny. My Kershaw Blur, "assisted opener", comes out just as fast, of not faster than my Gerber A06 "automatic". I agree with the comment upstream, put it in your pocket and worry about more important things in life... just my outlook, YMMV...

They probably aren't reliable for feeding in a semi-auto so best used only in revolvers. I've shot a few just to verify function so I don't remember how they recoil. About "louder", we're wearing hearing protection so only the snake/rat can comment. These seem to only work if you're very close to the critter and might only piss off a human if used in a SD situation.

I've only used them in 22LR in a revolver, others should be able to tell you on calibers.
 
What are those rounds with the blue caps? (I'm new!) Are those metal BBs in there?

I load my own in .38 and .44 caliber. I use #7 1/2 lead shot. Yes, they work. Copper heads, one timber rattler, and many rats.

I carry rat shot in my SP101 Ruger whenever I'm on the tractor. Seems like every time I bush hog or make hay, I have to defend myself from those critters.
It's fun to blast them from the tractor seat, just got to get them quick.

CCI makes them for .22LR, .22 WMR, .38/.357 Mag, 9mm, .40, .44 SPL/Mag, .45 ACP and .45 Colt. Speer makes shot capsules for reloaders like me in 38/44 cals. For cycling you'll have to shoot some out of your gun to determine. Tad less recoil and noise.

For OP question, I no longer have my Benchmade auto openers but not because of the state.
