9th Circus got it right. Overturns CA mag ban.

They may ask the full panel to hear it before they’d go to SCOTUS. In the meantime I’m upset with a TX judge for dissenting and for whatever legal mumbo jumbo continues to make the sale of such magazines illegal until something else happens.
 
You can bet that Bloomers is promising campaign donations to the AG and Gov if they do not appeal this to SCOTUS.
Maybe ... but if CA does try what are the odds the SCOTUS will actually hear it ... they’ve pretty much turned away gun cases lately ... and if they did I’d sure worry about Roberts.

Yup. That moron seemed to think unconstitutional rulings in other circuits were binding on all circuits.

Maybe the Microstamp case can get a review. That law is designed to eventually ban handguns in CA.

I think we have pretty good odds of this turning out favorably for the 2A whether it’s left as is or contested.

It is excellent precedent for future attempted actions by the democrats against standard capacity magazines. Maybe I can stop buying them for a while.
 
So next time somebody asks the dumb question about what Trump did for the 2A that Obama didn't or how Trump is any better than Obama, here it is. The 9th circuit was full of nutjob tree huggers until Trump's appointments.

The best thing that Trump has done for the country is in his court appointments. They will have the longest impact on society and help hold the barbarians at bay.

The court cited public comments from Sen. Harris about the black community not calling the police and having to rely on Non LEO self defense. :)

Yes and no. Lots of sellers are still blocking CA orders until they get clarification on how to do it legally.

So much so that some vendors were giving them priority.

Would / could this kick off a magazine buying run not only for CA but overall paired with the election?

What's the steps now that they overturned it?

What will this do to other states bans?
It’s only binding on those states covered by the 9th, think SW. However, if there are conflicting decisions in different circuits the supreme court may be more likely to consider the case...for better or worse.
 
I don’t understand this whole circuit judgements, they can issue nationwide injunctions against actions that the Trump administration takes but only limited to certain states on a 2A issue.

I just searched for some common mags yesterday and found they were sold out everywhere that had decent prices. Ended up buying from Wilson Combat directly because they had the lowest prices I could find. That's unreal and just due to the covid prices. This run is going to be insane now with starved Californian's jumping in.
 
Great news for those that are effected by this. If California tries to appeal to the USSC. The Supreme Court has already refused to hear other cases on the same issue against other districts. Again country's courts have conflicting decisions and they refuse to act.

Anyone who looks to ANY federal or state or local institution to save ANY of their rights is an imbecile, flat out.

HOWEVER, I am deeply grateful for this ruling. If unappealed, it can and will serve as case law which other courts can and will use to overturn laws in other districts, even though this is only "binding" in the 9th. It is great news and we should be happy.

Trump's appointments have completely reversed the most liberal circuit in the nation. The next time someone yowls about how Trump is a complete sell out on 2A because of some bump stock ban (which I too was disappointed about!), remind that intellectual behemoth of this. If you demand perfection or nothing, you will get nothing every time.

When I say "Trump is the best president we have had in a long time" I am not saying I want to run away with him and have his baby. I am saying that of all the turds in the pile, he is the least offensive. For the people who just cannot accept that as being enough, my response is that they (stupidly) expect far too much of elected leaders. This is Trump's doing flat out, and he deserves a huge "thank you."
