Is this a real question?
I mean, are you really asking someone to do this for you?

I've offered satisfaction guarantees to people a number of times.
"hey, you know i like guns, and i want that guy. go ahead and buy it and if you don't like it, sell it to me for the price you paid. you either get a good gun or you come out even"
plenty of gifts back and forth too. and extended loans.
all legal, mind you. all legal.

IIRC it's a straw purchase only if the buyer believes the intended recipient cannot legally purchase the firearm on his/her own, i.e. would fail the NICs check.

Agreed with this.

Some acting like this man trying to break the law, he's just trying to get a deal.
No different than when Ive asked out of state people to get a car part for me and ship it here (when seller doesnt want to ship)

Nope. Not true. The ā€œsecond buyerā€ can be completely legal to purchase a firearm and itā€™s still a straw purchase.

And Iā€™m not digging my heels in saying the situation being discussed here is a straw purchase. Iā€™m just saying a straw purchase isnā€™t just when the person who ends up with the firearm is a prohibited personā€¦which is also what I thought it was for many years.

But youā€™ll hear several LGS employees on here talk about denying purchases when they overheard conversations in the store about one person buying it for anotherā€¦and that holds true whether the second person can actually pass a NICS check or not.

FWIW, ATF says:

A ā€œstraw purchaseā€ is an illegal firearm purchase where the actual buyer of the gun, being unable to pass the required federal background check or desiring to not have his or her name associated with the transaction, uses another person who can pass the required background check to purchase the firearm for him/her. Those who purchase firearms in this illegal manner are subject to 10 years in prison and a $250,000 fine.
If you intentionally buy a firearm with no intention of being the actual owner, that seems to make it a straw purchase.

While not being local isnā€™t the ā€œcanā€™t pass a BGCā€ or ā€œdesiring to not have his/her name associatedā€, and they donā€™t meet the listed exception, the person buying is lying on the 4473 when they answer ā€œyesā€ to 21.a. based on the warning:

21. Answer the following questions by checking or marking either the ā€œyesā€ or ā€œnoā€ box to the right of the questions:
a. Are you the actual transferee/buyer of the firearm(s) listed on this form and any continuation sheet(s) (ATF Form 5300.9A)?
Warning: You are not the actual transferee/buyer if you are acquiring the firearm(s) on behalf of another person. If you are not the actual transferee/buyer, the licensee cannot transfer the firearm(s) to you. Exception: If you are only picking up a repaired firearm(s) for another person, you are not required to answer 21.a. and may proceed to question 21.b.

Thanks. I graciously accept gifts.
I don't give people to buy guns for me though.
Well, there was that one time my wife bought a gun i wanted while she was out shopping, but she used her card on my account... so i'm still not sure what happened in that circumstance

So I have to ask, what's the gun?
just another walther. not worth a lot, not worth the price a lot of people are asking. older and harder to find though, and supplies are limited in a time of high demand.

The first paragraph does not support your following comment:
"If you intentionally buy a firearm with no intention of being the actual owner, that seems to make it a straw purchase."

Regarding question 21, if I intended to eventually sell or give the firearm to another individual after using it myself would I be lying? That's up for debate, but this is something that can be impossible to prove either way without a mind reading device (unless of course I made statements to that effect beforehand).
