A āstraw purchaseā is an illegal firearm purchase where the actual buyer of the gun, being unable to pass the required federal background check or desiring to not have his or her name associated with the transaction, uses another person who can pass the required background check to purchase the firearm for him/her. Those who purchase firearms in this illegal manner are subject to 10 years in prison and a $250,000 fine.
If you intentionally buy a firearm with no intention of being the actual owner, that seems to make it a straw purchase.
While not being local isnāt the ācanāt pass a BGCā or ādesiring to not have his/her name associatedā, and they donāt meet the listed exception, the person buying is lying on the 4473 when they answer āyesā to 21.a. based on the warning:
