Baker gets to pay a fine (paid for by us, of course) and make changes to prevent him from any more of his 2nd Amendment cowardice.


RALEIGH, NC (June 14, 2021) — Today, FPC announced the entry of a consent decree, pending approval from Federal District Court Judge Louise Flanagan of the Eastern District of North Carolina, in the FPC lawsuit against Wake County, North Carolina Sheriff Gerald M. Baker that challenged his decision to shut down the county’s firearm permit processing in early 2020 during the COVID-19 pandemic. The consent order in Stafford v. Baker can be found at FPCLegal.org.

Under the terms of the order, Sheriff Baker “has agreed to modify the [Pistol Purchase Permit] application process so as to minimize or alleviate the admission of applicants for said permits to the Public Safety Center during the term of the current declared states of emergency” and also “immediately resume processing applications pursuant to state law.” Sheriff Baker has also agreed to pay the plaintiffs a collective $1,300 “for any damage the suspension of processing PPP applications may have caused” in addition to $25,000 for their legal fees and costs.

I have a hunch, he will still slow walk the process as it isn't costing him personally.
The judge finding him to be in contempt will sting far more than any monetary penalty, and I think the plaintiff’s are eager to go back to the judge and complain.
 
$1300 in damages is a joke. Any delay of a constitutional right should come with a shockingly large monetary penalty. But I guess we’ll take what we can get so that FPC & GRNC can mark it as a win and move on to the next one.

It should be $1300 per person who has been delayed.

If he was paying I’d agree, but since the taxpayers are paying a large penalty is no more effective than a small one.

In an ideal world... sure we could settle for prison. Sadly, that’ll never happen these days. Financial penalties that hit their budget and bad press are about as good as it gets.

??? I think you misinterpreted my post. I never said anything against these groups, both of whom I actively support. My comment is against the system, circumstances, and injustice. As I said, take the win and move on to the next one.

I'm sorry I misunderstood. I re-read your post and I see now what you were trying to say. Get what you can this time, and move onto the next one.
 
FPC has really been doing what the NRA should be doing 24/7
Gun Owners Of America, FPC, 2AF, and GRNC have been at the forefront of nearly every gun battle we've had for at least ten years. NRA serves only to take the heat while the others quietly rack up the victories.
 
Wake County Sheriff Baker pays nearly $30K for his malfeasance



Elsewhere, GRNC, SAF and the Firearms Policy Coalition settled their lawsuit against Wake County Sheriff Gerald Baker, Stafford v. Baker, for nearly $30,000. Most important, however, is the statement that:



“…it is hereby ORDERED that the Wake County Sheriff’s Office and Defendant Sheriff Gerald Baker accept and process PPP applications fully consistent with Chapter 14, Article 52A of the North Carolina General Statues, including the statutory deadlines therein, and this Consent Order.”



Said GRNC president Paul Valone:



“Grass Roots North Carolina intends to ensure citizens’ rights are respected. The days of certain sheriffs ignoring state law by refusing to issue handgun permits are over. GRNC’s two suits against Baker are the beginning of what may be a series of lawsuits designed to extract compliance with recalcitrant sheriffs. Look for the next one to be filed in coming days.”
