Legal or not to shoulder

Does anyone know, and if any alphabet groups are looking feel free to join in, if you do not have anything on an AR9 pistol buffer tube, just the tube itself, can you leagally shoulder the weapon, as in lighty rest it against your shoulder?
 
Since so far even the ones that have braces that if we are honest are nothing but a proper stock can be shouldered why would it not be legal to shoulder one with the naked buffer tube? Where did you get the idea, OP?
 
To my knowledge no one has been charged for making an SBR that did not have a reasonable approximation of a stock.

Kelland Wright was. Cane tip on a Maxim cheek rest. No brace at all. Hit with SBR charges, went all the way to trial.

His public defender wiped the floor with the ATF.

.................as opposed to firmly? Would it make a difference and if so how do you prove it one way or the other?
