Pistol Brace Rule Officially Published 1/31/2023 - Important info to protect you and your FFL friends - Fingerprinting Options Available

BEFORE ANYONE COMES FOR ME ON THIS POST, PLEASE REMEMBER I AM JUST RELAYING INFORMATION, I AM NOT THE CREATOR, A SUPPORTER, OR ANTHING RELATED TO IT

As we suspected the Pistol Brace rule was formally published in the Federal Register this morning.

So what does this mean?

Well - As of this morning, if you have a pistol brace on a AR platform that's barrel is under 16", it is now been reclassified as a Short Barreled Rifle and is subject to registration under the NFA and it may NOT be transferred to anyone else without first completing the form 1 registration and receiving the stamp (This is free for next 120 days), then completing a form 4 transfer that will still cost the traditional $200 tax stamp.

But wait - I thought I had 120 days? You do, technically you won't be charged possession of an SBR for those 120 days, but after that if you don't have the proper form 1 submission done, you are liable.. (Note - They have explicitly said that they won't be approved in 120 days and that submission of the form 1 will be all that is required to be considered in legal possession until your form 1 is adjudicated)
The way they enforce this is that you had to own this pistol braced weapon BEFORE the rule was published in order to get the forbearance.

As stated they have given you a few options
1) put a longer barrel on it, now its a rifle, no harm, no foul
2) remove the brace, put a pistol buffer on there and its a pistol again. No harm, no foul
3) register it as an SBR within the 120 days. Doing this requires fingerprints, photographs, and possibly engraving
4) destroy it / turn it in to the ATF

I would be shocked if anyone chose option 4. But hey, there are plenty of dummies out there so who knows.

Please also remember that your local friendly FFLs like me are held under a different scrutiny and have very little "wiggle room" here. Please don't put us in a bad spot because if we come into possession of an unregistered SBR, we cannot legally give it back.
