Can I buy an AR pistol now (during the 120 day period instead of before) and still receive a free stamp?

I was wondering the same thing, I had a lower I purchased before Jan 31, with grand plans of building it out as another pistol. But the ruling had already been announced by 13jan.

Lower was built out as a pistol but I didn’t have funds to finish the upper before 31jan. I didn’t put this one in my trust. Did run it with a 10.3 barrel upper to make sure it functioned.

Could I still register this one but as individual or would it be violation? I’m not trying to get around doing it and don’t want to break any law

As a $200 eForm, probably but I doubt as the free one

I’d say legally it wasn’t a pistol or rifle prior to 1/31. Hard to be either of those without a barrel.

I think what he meant to say was he hadn’t been able to build the permanent upper, but used another one as a short-term fix. And had a Schedule A or Assignment of Property form dated sometime before 1/31/23 with that serial number listed. Or at least that would be my story…😎

Even if the upper was completed after the 31st, the lower with a brace would still be legally a pistol lower, and eligible. Right?

When you file a form 1 and put the OAL, you aren’t assembling an illegal SBR and measuring it. You’re giving the measurements of what will be the finished product that you build after you get the stamp, no?

It had to be in SBR configuration ( braced) and a complete gun before the 31st....legally.

There’s no such thing as a pistol lower (or a rifle lower). 😉

A lower with a brace, or a stock, is an other firearm…not a handgun or long gun.

So, not eligible.
