If your AR pistol becomes a SBR

It looks pretty likely that AR pistols and others are going to become SBR's . So what are you planning on doing with your pistol? Is removing the brace on an AR enough?
 
Why does it seem pretty likely?? I think it’s a stretch to make such sweeping change to the law unchecked. It’s far from anyone’s focus right now because of the election but I believe it will be addressed as it impacts millions of people.

But to answer your question, the ATF already gave their opinion on what your options are.
 
98% of people will buy a stamp because that's what law abiding citizens do.
1% of people with get pissy enough to remove the stock and/or sell.
1% of people will probably shout taxation is theft while doing absolutely nothing different.

Honestly I doubt 98% will buy a stamp, if so then legal sbr/sbs and suppressors would be much more common. I personally know a lot of people who won’t go through the process/time/cost of the stamp but have multiple AR/AK pistols. If I had to guess I’d say MAYBE 50% of current “pistol” owners with a brace will go the stamp route, 30ish % will turn in or destroy the brace and replace the upper, or just throw it in the safe. And the other 20% will say screw it and keep on keeping on. One thing about the brace is without laying eyes on it, no one knows it’s “illegal” so if you’re shooting on private property, unless you show it off, no one knows you have it.

lots of places even on private property, neighbors are close enough to report “machine gun” shooting so it would make it harder to use a bump stock inconspicuously.

It's not just the $200 and the year wait, you also have to (potentially) do the stupid trust, and get photos and finger prints and whatever else they come up with. That's a major hassle by design, and it works to keep people from doing things. I know several people who wouldn't care about the $200 if it let them get an SBR/SBS/suppressor. it's the hassle that keeps them in line.

Yup the hassle of Tax Stamp stuff is what has kept me out of the SBR/Supressor market. It is too much of a hassle to deal with for the minimal gain. To the OP I am not sure that it is likely to go that way. No one is really privy to why the ATF did what it did to Honey Badger. As of today I do not know of anyone else they have gone after. That does not mean that they won't but the sky has not fallen yet.

If braces are made to be illegal, wouldn’t qualify as a pistol anyway AFAIK.

Right.... as they stand now they are pistols. There are lots of implications beyond just taking the brace off and putting a stock on it. Just saying.

The joke was, if a brace makes me a felon, I’m just going to put a stock on it.

The ATF needs to be abolished and someone needs to turn it into a store that sells what’s in the name.

Iirc the wait for a form 1 is very short

I know a while back it was around a month. From SilencerShops website it looks much longer now. Could be wrong.

Pay Tax Stamp and register SBR. Also you will no longer be able to conceal carry it in a vehicle. Theoretically......
Theoretically I let my CHP lapse when it expires in January and no longer GAF.

One less database entry for me on the LPR scanner

I’m not saying I like it, but it’s not really much of a hassle. Take your own photo. Roll your own prints. EForm approvals in the 15-25 day range.
 
On subject but off a little. Can you efile sbr and supressor at the same time qith the same prints?

Yes.

Have to file separately (the system looks like you can do multiple firearms, or at least it used to, but you can’t)...but you can send multiple cover sheets in one envelope with a single set of prints.

All I was saying is the process itself isn’t nearly the hassle a lot of people think. Most of it can be done at home on your own time.

No doubt. Before I changed home addresses I had 3 completed form 1s ready to go. Then the Batfeces boys went and pulled the crap with bumpstocks (with Trump's blessing). Now the brace fiasco and arbitrarily/incorrectly measuring LOP. Not feeling really confident in sending them an extra $600 to put myself on another list, a blank check for "inspection" and more of my info out there

Not when hundreds of thousand people decide to register at once. Some will pay the tax, others will disassemble and build a rifle. Others have just remove the brace and shoot it as a handgun still. Last category are those that will do nothing.

The downside to this is getting everyone to follow so it cannot be enforced. Because 99% of people don’t have the funds or legal expertise to go against the ATF, even if what they are doing is dead wrong. Same thing that happened with bump stocks.

That's the problem everyone wont stick together. There are alot of things that could change if everyone would stick together.
 
I dont own one but i thought the manufacturers designated these things as pistols from their factories. So it seems to me that there is a lawsuit coming from all the owners who bought a "pistol" the way they were legally supposed to. If you told me that overnight my car became a diesel truck and i had to pay gas guzzler taxes on it, id be looking for a lawyer. Im probably missing something...usually do.

Depends on if it was bought as a complete firearm or a stripped receiver. If it was complete then yeah it should have been transferred as a pistol. It it was a stripped receiver then it should have been transferred as a other.
