Denver Patriot killed by Anitia Press Security

It appears victim slapped the shooter to repel shooter grabbing at the pepper spray. Victim backs up. Victim then sprays while shooter is drawing. Shooter raises weapon and fires. I guess I'm naive. Probably not ND.

Shooter in employ of press? Don't know. Antifa and MSM have merged regardless.
 
Can't see the shooter getting off on using deadly force against bear spray either, keep us posted how this develops.
 
Since when is it OK to shoot someone for using bear spray?
 
This is leftist Denver, the shooter will be a lower charge ... along the lines of manslaughter ... because “he was defending himself and the crew against a white supremacist”. The legal system out there and leadership will cow down to the leftist because of political agendas as well as the threat of rioting ... think like Kyle Rittenhouse was already pretty much “convicted” by the DA in Kenosha for defending himself
 
Lee had bear spray in right hand all the time.
I missed that - the second photo it looks like his hand is empty and going for something. In the first photo though I can see the can with a black cap. Now that's a tough call, but I probably would not have observed a deadly threat. It's hard to say what the shooter saw.

But I can tell you I would not have been there doing what either of those fine people were doing.

As I was a CO resident for quite some time, the statutes for self-defense have been contested in the courts quite often, with some questionable shoots being let go. I would not be surprised to see this one being one of them. Especially so as we do not see what occurred "off camera", and if the DA/grand jury sees pepper spray as a threat of "great bodily injury".

Colorado Revised Statutes Title 18. Criminal Code § 18-1-704. Use of physical force in defense of a person

(1) Except as provided in subsections (2) and (3) of this section, a person is justified in using physical force upon another person in order to defend himself or a third person from what he reasonably believes to be the use or imminent use of unlawful physical force by that other person, and he may use a degree of force which he reasonably believes to be necessary for that purpose.

(2) Deadly physical force may be used only if a person reasonably believes a lesser degree of force is inadequate and:

(a) The actor has reasonable ground to believe, and does believe, that he or another person is in imminent danger of being killed or of receiving great bodily injury;  or

(b) The other person is using or reasonably appears about to use physical force against an occupant of a dwelling or business establishment while committing or attempting to commit burglary as defined in sections 18-4-202 to 18-4-204 ;  or

(c) The other person is committing or reasonably appears about to commit kidnapping as defined in section 18-3-301 or 18-3-302 , robbery as defined in section 18-4-301 or 18-4-302 , sexual assault as set forth in section 18-3-402 , or in section 18-3-403 as it existed prior to July 1, 2000, or assault as defined in sections 18-3-202 and 18-3-203 .

(3) Notwithstanding the provisions of subsection (1) of this section, a person is not justified in using physical force if:

(a) With intent to cause bodily injury or death to another person, he provokes the use of unlawful physical force by that other person;  or

(b) He is the initial aggressor;  except that his use of physical force upon another person under the circumstances is justifiable if he withdraws from the encounter and effectively communicates to the other person his intent to do so, but the latter nevertheless continues or threatens the use of unlawful physical force;  or

(c) The physical force involved is the product of a combat by agreement not specifically authorized by law.

(4) In a case in which the defendant is not entitled to a jury instruction regarding self-defense as an affirmative defense, the court shall allow the defendant to present evidence, when relevant, that he or she was acting in self-defense.  If the defendant presents evidence of self-defense, the court shall instruct the jury with a self-defense law instruction.  The court shall instruct the jury that it may consider the evidence of self-defense in determining whether the defendant acted recklessly, with extreme indifference, or in a criminally negligent manner.  However, the self-defense law instruction shall not be an affirmative defense instruction and the prosecuting attorney shall not have the burden of disproving self-defense.  This section shall not apply to strict liability crimes.

If pepper spray is treated as GBI, one might as well use a regular firearm.

I do not disagree. My suspicion is the narrative will flip because of the ban of pepper spray and other "non lethal" strategies unless inane "authorizations" are granted in jurisdictions such as Denver, Seattle, etc.

We will see.
 
Still going to be hard for the shooter to prove that he was in immediate threat of his life with LE just behind him. We need to see who started the contact between the two. My bet is the shooter grabbed for the bear spray.

Now the news station has a vested interest in this guy getting off so they won't be sued into oblivion since he was working for them.
 
Is it just my old ass eyes or does that look like a loaded round being ejected? Maybe it is just the lighting.
It kind of looks like that but going by his hand position that can't be possible. Probably what we're seeing is the bottom of the casing reflected in the light.

Did anyone notice that the bullet is visible, just prior to hitting the victim in the throat?

You can see the shock wave, turbulence with the fence post behind it, and the bullet at the apex of the wedge of the wave.

Musta severed his spine, just below his head.

You can see it even without cropping. Since it went through the cloud of pepper spray, the shock wave is made more visible. Looks like it just missed his hand... that might have saved his life.

I often see the phrase around here “play stupid games, win stupid prizes”. Slapping people in the face and hitting them with bear spray qualifies as stupid games, even if you are morally “right”. Maybe slapping and bear spray will turn out to be self defense but since the gun was not involved yet and Mr. Bear Spray is the one doing the slapping that’s hard to claim at this point.

Everyone involved in this situation is getting a stupid prize, some more permanent than others.

I’ve seen a couple claims that the shooter was trying to take the bear spray and got slapped. It comports with the hand positions of both parties and when combined with the retreat of the victim makes it pretty likely that the shooter made a grab, the victim evaded by slapping and retreating, the shooter drew, the victim fired what he had, the shooter shot him.
We don’t have all the evidence, but I don’t see how the shooter can claim defense of himself or another when he started the altercation and escalated it.

Gun was drawn before bear spray was sent. Reach for my stuff and a slap will be a mild response.
You need to look a little closer at what evidence is present.
 
Just saw this posted over at cast boolits. If true, then the first (black) guy that the victim was engaged with was an employee of the paper, hired to stir things up. That’ll make things interesting.

“Channel 9 in Denver have this same black guy at other events trying to provoke reactions. Well documented. They film it and put it on the air. They goofed up and hired a psycho this propaganda trip. Hope they get sued.”
 
if political affiliations were switched i can see people saying the shooting was justified...

pepper spray could incapacitate and he could take his gun...

I should clarify, my self defense statement wasn’t in regards to legal guilt or innocence of either party, but rather guilty of playing stupid games and winning a stupid prize.

I know it’s unpopular opinion in this thread, but I don’t view this is a patriot vs antifa casualty. This is 2 dudes playing stupid games that let their ego escalate until they both got a stupid prize. Also a stupid game and prize by the newspaper hiring private “security” like Denver is Fallujah circa 2004.
 
What would be going on if the shooter was a Trump supporting security guard for a FOX News crew and the dead guy was a leftist? I’m guessing there would be protesting outside the Denver jail with torches and pitchforks and MSM would be blasting it at the bottom and top of the hour for the next week ... “Trump supporter murders peaceful counter-protester” or such.

Pepper spray already out and clearly visible. There was no "reaching for it"
