Gun rights victory at NC General Assembly - Mar 15

S.B 41 was over-riden by the senate and now goes to the house. As I predicted the first thing that got brought up was Nashville it might be the event that breaks Democratic support for the over-ride in the house.

These type of events happen every time Congress is debating more gun control. It can no longer be viewed as mere coincidence.
This latest nut job, we are to believe, had the clarity to scope out the security at multiple schools and choose her alma mater, in the end due to it having the weakest security. We are to believe this has nothing to with that ANTI (FBI asset controlled) advertised a Day of Vengeance and did not train people up, then wind them up with hate rhetoric, and send them out.
4 mass shoots with mentally ill people who "identified" as something other than their sex.
 
In one of the seven active threads on this topic, I saw where the PPP part of it was effective immediately.
So this means my 20 year old son can walk into a gun store with a driver's license and buy himself a pistol?

No. He still needs to be 21 to purchase from a gun store (FFL).

He just doesn't need a PPP to buy from his buddy, or neighbor, or any other NC citizen.

he didn't need a PPP before, but many used it as a way to verify the person was legally able to purchase/possess a handgun. NC law only says that in private sales a person cannot sell to a person who they KNOW cannot purchase/possess it.

“EFFECTIVE IMMEDIATELY, any person seeking to purchase or transfer a handgun in North Carolina is no longer required to apply to the sheriff for a pistol purchase permit,” it said. “All pistol purchase permitting laws in North Carolina have been eliminated by the enactment of Senate Bill 41, Guarantee 2nd Amend Freedom and Protections.”

Memo: “Any person seeking to purchase a handgun through a firearms dealer will undergo the National Instant Criminal Background Check System (NICS) criminal background check required under current law and either be sold the handgun or denied sale if a criminal history search indicates the person is disqualified from possessing a firearm. For private transfers of handguns, while no National Instant Criminal Background Check System (NICS) criminal background check is required under current law prior to making a private transfer, criminal penalties still apply to any person that knowingly transfers a handgun to a person who may not lawfully possess the firearm.”

You're saying the law they just repealed didn't apply to someone buying a pistol from a private party?
 
I wonder if you actually really could go buy a handgun right now in NC with only a NICS check? FFL's and LGS's are somewhat shell shocked by uptick in ATF inspections and they are under no mandate to sell you anything if they dont want to.

It had a couple things in it, but as far as the PPP, it did away with the Pistol Permit process all together. Read the Alamance County statement above. He clearly says that CURRENT law for private sales is still the same in NC. No permit required. This BILL did not change the no requirement needed in private sales of a handgun IN NC. The current NC law states the person cannot KNOWINGLY sell to someone who they KNOW cannot possess it.

You can even buy one without a NICS check! Private sale.

FFLs can do what they want, but they'd be pretty stupid to turn away business by requiring a permit that was repealed and which isn't even being issued anymore by the sheriffs.

Buyer had to have a PPP or CHP to legally buy a handgun. Regardless of buying from an FFL or not.

@DogFather mentioned his son and a driver's license. I assumed that to mean his son doesn't have a CHP.

If his son doesn't have a CHP, then he would need (pre-repeal) to have a PPP to legally purchase a pistol from a private party. Now, he doesn't.

At least that's how I understood it, but being I'm in SC, I don't have a dog in this fight.

I'll just say I'm glad to see this has happened for NC residents.

That's not current NC law for private sales. Please post that law. My Sheriff in Davidson County made that clear to me a few years ago. To be criminally liable one must KNOWINGLY sale to a person who they KNOW cannot possess it. Read Alamance County SHeriffs memo. He knows the law and clearly states it.
 
Huge win for young adults, who can finally purchase handguns legally across the state.

The cop cars here in Person County have "wE tHe PeOpLe" and American flags plastered all over them, but the sheriff wasn't issuing PPPs to 18-20 year old adults, in clear violation of the Constitution (and even though the existing NC law didn't require a 21 age limit).

I hope as many young adults as possible buy handguns privately and carry them with a New Hampshire nonresident carry permit.

I've noticed that most people on this forum, when offering a gun for sale (pistol or rifle), ask for a PPP or CHP as a means of vetting. Without the option for PPP, I wonder how the sellers will react.

Maybe this will be an incentive for more people to get their CHPs.
Or it will be an incentive for Fudds to stop asking for things not legally required. A simple, verbal "Are you 18+, an NC resident, and not a felon?" will suffice, thank you very much.

I'm open to have my opinion changed. Like I said, post that law so I can educate myself. I had the discussion with the Sheriff of my County BEFORE this repeal of PPP today.

Before today's overriding the veto vote, anyone buying, receiving, etc., in NC had to have a PPP issued by the sheriff of the county they resided in. If you were told otherwise, you received incorrect information.
