Polygonal rifling maybe? Maybe some not traditional rifling like the new multi-radial-rifling, and the ATF doesn't consider those rifled barrels?

Barrel can't be extending into the upper unless that's a funky proprietary mag with a really short round chambered.
Somehow they got this thing classified as either a pistol or "firearm" (as in doesn't meet any defined classification not AOW) based on the add because it says it's not a rifle or shotgun.
Saw that theory explained as well...It's the trigger. They have that binary trigger, so if this gun doesn't have a semi auto only trigger, then it isn't technically a rifle. And if it isn't a rifle, it obviously can't be a short barreled rifle. Here's the legal definition of rifle:

Are they redesigning the safety, so that you can put it on safe with the trigger pulled, so releasing it doesn't fire the weapon? I had that thought as well. But, you can buy 2.5 stamps for the price of the trigger...last I checked it was $499, so it may have come down.So if this is true then couldn’t one just buy the binary trigger and do the same exact thing at home?

I got it figured out.
You know how you can buy an AR lower marked PISTOL? Well, these are simply marked FIREARM instead. If it's engraved, it must be true!!
It's equipped with their binary trigger system...
If you look at the photo from the press release, you can see the selector is switched to "BINARY". I cannot make it out clearly, but the topmost setting may be "SAFE". On the BFS lowers listed on their site, that setting is "SEMI".
If this weapon has a selector with only two settings, SAFE and BINARY, that may be their work-around.
This is how I initially read it and bet will be the outcome.If they build the firearm from a pistol and install their trigger, that might squeeze through. So they don't have to deal with ATF and FBI agents hounding them for manufacturing and distributing nfa items without the tax stamps being paid.
Likely harder for licensed firearms dealers to plead ignorance of there law where firearms are concerned. Especially when the ad for said item has " No tax stamp" printed on it in large bold letters.
